국문 초록

이 연구는 북한의 2016년 법전(증보판)에 기초하여 북한법령의 정비내용을 살피고, 기존의 법전에 비추어 어떠한 변화를 보이고 있는가를 분석한다. 김정은의 급작스런 정권승계 이후 일련의 대내외정책이 시행되는 과정에서 나타나는 법령의 변화를 분석하는 것은 북한의 현실을 법령을 통해 고찰하는 의미가 있다. 물론 북한사회가 우리와 같은 법치주의 사회에 기반을 두지 않고 있지만 형식적이나마 법치적 국정운영 또는 국정운영의 법제화의 방향으로 발전할 수 있는 움직임을 보이고 있다는 점에 주목할 필요가 있다. 김정일시대에 활발하게 이루어진 법제변화는 김정은시대에서도 견지되고 있다. 2016년 북한 법전은 ‘증보판’의 형식으로 2012년 출판된 ‘조선민주주의인민공 화국 법전’이후 4년의 기간 동안 제ㆍ개정된 법령의 전문 또는 해당 조문들을 수록하고 있다. 따라서 2016년 법전은 김정은 정권이 시행한 기본적인 법령의 내용을 포함하고 있다. 새로이 제정된 법령과 개정된 법령은 김정은정권의 정책 방향과 내용을 담고 있기 때문이다. 여기서는 2016년 법전을 전체적으로 살펴 대체적인 법전의 구성과 체계를 분석하고, 몇 가지 법령을 통해 개정의 방향과 특징을 고찰한다. 이를 통해 김정은체제의 법제정비의 내용을 일별하고 향후 법령의 수정의 방향을 전망해본다. 이로써 북한의 김정은 체제의 입법을 통해 나타난 정책방향을 살펴봄으로써 북한의 법제현황을 파악하는 데에 도움을 줄 수 있다. 따라서 이 분석은 개별법에 대한 분석 보다는 전체적으로 2016년 법전의 형식과 내용을 중심으로 언급하고 그 특징을 파악한다.

영문 초록

This study examines the contents of the revision of the North Korean legislation based on the code of law in 2016 and analyzes what changes are taking place in light of the existing code. In particular, analyzing the changes in laws and regulations in the course of Kim Jongun s sudden regime succession in the course of implementing a series of internal and external policies has the meaning of examining the reality of North Korea through statutes. Of course, it is worth noting that the North Korean society is not based on the same rule-based society as ours, but it is moving in the direction of legalization of the rule of law or state administration. Changes in the legal system that have been active in the Kim Jong Il era have been recognized in the Kim Jongun’s era. In 2016, the North Korean Code will be issued in the form of a supplementary edition for a period of four years after the Code of the Democratic People s Republic of Korea. It contains the full text of the revised statute or its articles. Thus, the Code of Civil Procedure in 2016 contains the contents of the basic laws and regulations imposed by the Kim Jongun’s regime. The newly enacted laws and amended laws and regulations contain the direction and content of the Kim Jongun’s policy. Here, I look at the whole code of 2016, analyze the composition and system of alternative codes, and examine the directions and characteristics of revisions through several laws and regulations. Through this, I will look at the contents of the legal system of Kim Jongun’s regime and look forward to revising the law in the future. This can help us to understand the current status of the legal system in North Korea by looking at the direction of policy through the legislation of the Kim Jongun’s regime. Therefore, this analysis focuses on the format and content of the 2016 Code as a whole, rather than analyzing individual laws.
