국문 초록

최근 유럽에서는 EU에서 영국이 탈퇴를 선언하였다. 이 때문에 주변국들은 유럽통합이 지속될 지에 관한 의문을 제기하고 있는 것이 사실이다. 그러나 유럽통합은 이미 기정사실화 된 것으로 전체를 되돌리기에는 돌아올 수 없는 강을 건넌 것으로 보인다. 2000년 후반 동유럽으로 EU 회원국의 수가 급격하게 늘면서 유럽 통합은 더욱 가속화되어 왔으며, 유럽통합이 진전되어 갈수록 유럽연합의 회원국 들은 자신의 권한 중 상당 부분을 유럽연합으로 이양하고 있다. 본고에서 중점적으로 다루고 있는 유럽연합의 회원국인 독일과 같이 연방국가의 형태를 취하는 나라의 경우, 연방에 속한 각 주들은 지방정부로서의 성격을 넘어 하나의 국가와 같은 성격을 가지고 있기 때문에 연방국가의 형태를 취하고 있는 나라들의 EU로의 통합은 더욱 어려운 양상을 보이고 있다. 오늘날 독일의 지방정부가 지키고자 했던 자치권의 보장은 유럽통합과정에서 완전히 실현된 것은 아니지만 어느 정도 보완된 것으로 평가할 수 있다. 유럽연합 내 회원국에서의 지방정부의 입장은 유럽연합 차원의 의사결정절차에 자신의 이익을 대변할 수 있도록 참여권을 보장해 달라는 것이었다. 비록 유럽통합의 과정에서 회원국의 지방정부는 자신의 자치권의 상당부분을 상실하였다고 하더라도, 이후의 자구책을 통해 적극적인 협력의 방법으로 자신의 자치권을 확보하게 된 것이다. 즉, EU 내 주(州)사무소의 설치, 주를 대표하는 참관인의 파견, 다른 지역과 협력관계 등을 통해 오늘날 유럽연합 내 지방정부는 자신의 자치권 확보를 위해 일정 부분성과를 이룬 것으로 보인다. EU 내 주사무소는 유럽연합의 정책결정을 함에 있어서 비정부 기관 등을 통해 영향력을 행사하고 있다. 독일의 주정부는 자 국 내에서 유럽차원의 사안에 관한 결정에 대하여 실질적인 참여권을 헌법적으로 보장받을 수 있게 되었다. 이에 따라 주정부도 유럽 집행위원회와 지역위원회에서 EU 내 의사 결정 과정에 참여할 권리를 확보하게 되었다. 유럽 유럽통합이 회원국내 지방자치에 미치는 영향은 장차 동아시아 공동체가 형성될 경우 우리에게도 마찬가지로 일어날 수 있는 문제이다. 독일은 연방주의를 취하고 있다는 점에서 우리의 상황과는 다르다. 그러나 그 구조는 중앙정부와 지방정부로 구분되는 우리의 지방자치제도와 크게 다르지 않다는 점에서 법 원리와 제도적인 측면에서 도움이 될 수 있다. 본고에서는 기본적으로 지방정부의 자치권보장과 관련하여 유럽통합으로 인해 발생하는 연방정부와 지방정부 간에 발생하는 문제를 다루었다. 특히 유럽연합의 주요 회원국이며 유럽연합 내 가장 중요한 영향력을 행사하고 있는 독일의 예를 들어 독일 연방정부와 지방정부인 주정부 간의 권한배분이 어떻게 되어 있는지, 유럽통합이 주정부의 자치권에 어떠한 방식으로 영향을 미치는지를 살펴보았다. 통합의 과정에서 지방정부가 겪게 되는 자치권의 상실은 피할 수 없는 것인지도 모른다. 그러나 한편으로는 최소한 지방정부도 통합을 위한 의사결정의 주체로 나서기 위해 참여와 협력이라는 방법이 유용할 수 있다. 회원국의 지방정부가 자신의 자치권의 상실에 대한 보상의 차원에서 적극적으로 EU 내 하나의 의사 결정 기관으로 자리매김하려는 노력은 앞으로 동아시아 공동체가 형성되는 상황에 대 비하여 통합의 과정에서 우리의 지방자치단체가 자치권을 확보하는데 있어서도 참고가 될 수 있을 것으로 기대한다.

영문 초록

Recently, in Europe, the UK has declared its withdrawal from the EU. Because of this, neighbor countries are questioning whether European integration will continue. But European integration has already become a reality. It is too late to reverse the European integration. In the late 2000s, the number of EU member states grew rapidly in Eastern Europe. This makes European integration even faster. As European integration progresses, member states of the European Union transfer much of their powers to the European Union. The problem is in the case of a country that takes the form of a federal state, such as Germany, a member of the European Union. Each state of federal states has the same character of a nation. For this reason, the integration of the countries in the form of the federal state into the EU is more difficult. The assurance of the autonomy of Germany s local government today is not fully realized in the European integration process, but it was secured to some extent. The position of the local government in the Member States of the European Union was to ensure the right to participate in the decision-making process at the EU level in order to represent their interests. Actually in the course of European integration, the local governments of member states have lost their own autonomy, but later they have secured their autonomy through active co-operation. For example, the establishment of state offices in the EU, the dispatch of observers representing the state, and cooperation with other regions play an important role. Today, local governments within the European Union have achieved some success in securing their autonomy. The main office in the EU exercises its influence through non-governmental organizations in making policy decisions in the European Union. The states of Germany has a constitutional guarantee of substantial participation in its decisions on matters at European level. As a result, the European Commission and the regional committee have also secured the right for the states to participate in the EU decision-making process. The loss of autonomy of the local government in the process of integration is inevitable. On the other hand, in order for local governments to be the subject of decision-making for integration, the way of participation and cooperation is useful. It is meaningful that the local governments of the Member States in EU actively take the position as a decision-making body in the EU in terms of compensation for loss of their autonomy. This will be a reference in securing the autonomy of our korean local autonomous entities in the process of integration in preparation for the formation of the East Asian Community in the future.
