국문 초록

지방분권과 지방자치가 강조됨에 따라 중앙의 사무가 지방자치단체로 대폭이 양될 것으로 예상되고 있다. 지방자치단체가 수행해야 할 과제가 점점 세분화되고 다양화되는 현실에서 지방이 직접 급부를 제공하는 종래의 방식은 지방행정의 효율성을 저해하고 있다. 또 이러한 위기를 극복하고 각 지방의 발전을 도모할 창의적인 방안을 모색해야 하지만, 지방자치단체는 정책을 설계하는데 있어서 전문성과 인력의 한계를 가지고 있다. 지방자치단체의 행정 현실을 구체적으로 살펴보면 지방자치단체와 중앙행정부처의 지방특별행정기관들과 그리고 교육기관이나 경찰서, 소방서 등이 분리되어 있어 지방자치단체가 종합적인 정책설계와 집행을 하기 어려운 구조를 가치고 있다. 또한 지방자치단체장들이 선거기간을 주기로 바뀌거나 공무원들의 인사이동주기가 매우 짧고 여러 부서를 순환하기 때문에 공공서비스와 정책의 계속성을 유지하기가 어렵다. 이에 비하여 비영리민간단체는 자신이 추구하는 공익 실현에 대한 동기부여가 잘 되어 있고 계속성을 유지하기 때문에 정책의 계속성, 복지 등의 공공서비스의 계속성을 담보하는데 중요한 기여를 할 수 있다. 또, 현장에서 계속 공익활동을 하고 있기 때문에 주민들과 기업간의 문제상황 등을 잘 알고 있다는 점도 장점이다. 비영리민간단체들은 지역사회에서 기업과 주민들, 행정과 주민들의 이익갈등의 심화를 막는 완충자로서, 사회적 약자보호나 환경과 같은 공공재의 보호자로서, 그리고 행정실패나 시장실패를 보완하는 자로서 기능할 수 있다. 지역사회의 경제발전과 주민복지 등의 공적 과제는 지방자치단체의 힘만으로는 수행할 수 없다. 지역사회 전체의 적극적인 참여가 필요하다. 다시 말해 지방자치가 온전하게 실현되기 위해서는 지방자치단체, 비영리민간단체 및 주민들의 협력 관계 형성이 필연적으로 요구되며, 지방자치단체의 공익활동지원은 그 첫 걸음이 된다고 할 것이다. 최근 서울시, 부산시, 대구시, 광주시, 대전시 등의 광역지자체는 ‘시민공익활동 의 지원조례’ 등을 제정하여 비영리민간단체를 지원하고 있다. 지방자치단체는 지역사회에서 요구하는 서비스나 수요에 적절하게 대응하기 위해 비영리민간단체가 더욱 다양화 전문화 활성화 되어야 할 필요성을 절감하고 있으며, 지방자치단체와 비영리민간단체의 협치에 대한 중요성이 증대하고 있기 때문에, 비영리민간단체를 지원할 법적 근거를 마련하고 있는 것이다. 그러나 법제처는 여전히 “비영리민간단체를 지원하는 내용의 조례를 제정하는 것은 민간이 자발적으로 설립 운영하려는 비영리민간단체 본연의 성질 및 목적에 비추어 바람직하지 않다”라고 유권 해석하고 있다. 즉, 정부의 판단은 지방자치 현장에 있는 공익활동 담당 공무원들과 비영리민간단체의 현실에 전혀 부합하지 않고 있음을 보여주고 있다. 지역 비영리민간단체의 공익활동 활성화를 위한 지방자치단체의 지원확대는 단순히 자원봉사단체를 장려하는 차원의 것이 아니라 지방분권화시대에 각 지방자치단체의 고유한 자원과 특성에 적합한 정책의 형성 발전과 주민자치강화를 위한 필수적인 수순이라고 할 수 있다. 이와 같은 흐름은 일본에서도 찾아볼 수 있다. 지난 2000년 일본이 지방분권개혁 후에 각 지방자치단체는 지방자치단체의 발전과 공적 과제수행을 위하여 공익활동기본조례를 제정하여 지역 비영리민간단체지원을 위한 법적 근거를 마련하였다. 법적 근거에 따라 재정적 지원뿐만 아니라 행정과 지역 비영리민간단체 사이에 활발한 인적 교류, 정보교류를 정례화 하였고, NPO센터를 건립하는 등의 각종 행정지원을 하고 있다. 일본의 지방분권개혁이 본격화되는 과정에서 공익활동에 대한 지원이 확대되는 과정은 우리에게 시사점을 제공하고 있다. 본 논문에서는 일본 지방자치단체의 정책 중심의 조례제정과 비영리민간단체에 대한 지방자치단체의 공익활동지원을 통한 지방자치단체와 비영리민간단체간 협력체계를 소개하고, 그 시사점을 토대로 우리 지방자치단체의 공익활동지원의 법적 문제점과 그 개선방안을 마련하고자 하였다.

영문 초록

As decentralization and local autonomy are emphasized, central affairs are expected to be largely transferred to local governments. In the reality that the tasks to be carried out by local governments are becoming increasingly fragmented and diversified, the conventional way of providing local direct benefits is hampering the efficiency of local administration. It is also necessary to find creative ways to overcome these crises and promote the development of each province, but local governments have limited expertise and manpower in designing policies. In addition, it is difficult to maintain the continuity of public services and policies because the heads of local autonomous governments are changing the cycle of elections, or the cycle of personnel movements is very short and circulating among various departments. On the other hand, members of NPO(Non Profit Organization)s are well motivated to pursue the public interest that they pursue and maintain their continuity, which can make an important contribution to ensuring the continuity of policy and the continuity of public services such as welfare. Public tasks such as the economic development of the local community and the welfare of the inhabitants can not be carried out only by the power of local governments. Active participation of the entire community is needed. In other words, in order for local autonomy to be fully realized, cooperation between local governments, NPOs and residents is inevitably required, and the support of the local government s public interest activities is the first step. Recently, metropolitan governments such as Seoul, Busan, Daegu, Gwangju, and Daejeon have established nonprofit private organizations by enacting the Ordinance for Supporting Citizens Public Activities . Local governments recognize the need for more diversified, specialized, and active NPOs to respond appropriately to the demands and services demanded by the community. Therefore, it is preparing legal basis to support NPOs. Local government support for the promotion of public interest activities by local NPOs. is not just about encouraging volunteer groups. In the era of decentralization, it can be said that it is an essential step for the formation and development of policies and strengthening the self-government of local governments, which are appropriate to the unique resources and characteristics of local governments. This trend can be found in Japan. In 2000, after the decentralization reform of Japan, each local government enacted the Basic Ordinance for Public Interest Activities for the development of local government and carrying out public tasks, and laid the legal basis for supporting local NPOs. In addition to providing financial support based on legal grounds, it regularly promotes active human exchange and information exchange between administrative and NPOs, and provides administrative support such as building an NPO center. In Japan, as the reform of the decentralization progresses, the support for the public interest activities is expanded, which gives us implications.
