국문 초록

정부는 지방자치단체파산제도를 도입하려 하고 있다. 정부가 도입코자 하는 지방자치단체파산제도가 정확히 어떤 것인지는 밝혀진 바 없으나 현재로서 지방자치단체파산제도가 실정법 내에 자리 잡고 있는 경우는 미국사례가 유일하다. 미국사례를 통해 알 수 있는 것은 지방자치단체파산제도가 지방자치단체의 채무 조정을 통하여 회생을 도모함을 목적으로 하고 있고, 지방자치단체에 대한 일종의 구제조치로서 기능한다는 점이다. 파산법원의 선언을 통하여 지방자치단체는 자치행정을 이어갈 수 있고, 스스로의 책임으로 재정의 건전성회복을 위한 크고 작은 이행을 할 수 있다. 국내에 도입시에도 이러한 지방자치단체파산제도의 특수성이 잘 반영되어야 할 것이다. 그리고 지방자치단체파산제도를 도입함에 있어 그 본연의 목적과 지방자치제도의 본질적 측면을 고려하여야 한다. 지방자치파산제도는 우선적으로 지방재정의 건전화를 도모함을 목적으로 한다. 사전적으로 예방의 기능을 할 수도 있고, 사후적으로 관리의 기능을 할 수도 있다. 또한 자치행정의 지속을 목적으로 하고 있고, 채권자의 만족을 고려해야만 한다. 지방자치제도의 본질적 측면으로서 최소한의 자치권행사를 침해하지 않는 방법으로 지방자치단체파산제도의 도입이 논의되어야 할 것이다. 지방재정의 위기의 요인은 매우 다양하고 복합적이다. 내부적으로 지방자치단체의 방만한 경영이 문제될 수도 있으며, 중앙정부의 국고보조사업을 수행하느라 예산이 고갈되어 자체사업을 지속할 수 없게 되는 세입세출의 구조에도 문제가 있을 수 있다. 지방재정의 양적인팽창에 상응하는 질적인 팽창이 이루어지지 않아 재정자립도가 현저히 떨어지는 것도 문제가 될 수 있고 국내외적 금융위기가 결정적인 이유가 될 수도 있다. 이러한 원인에 따라 책임 소재를 명확히 다루고, 그 원인이 반드시 단체장의 방만한 경영에 기인한 것이 아니라면, 지방자치단체 스스로 재건 내지는 파산의 절차를 이행할 수 있도록 법제화되어야 한다.

영문 초록

Last february, the Minister of Security and Public Administration said that the government would adopt a municipal bankruptcy system. We don’t know what the municipal bankruptcy system exactly he had mentioned is and he did not explain about it specifically. We can only guess it is similar to the system of Chapter 9 of U.S Federal Bankruptcy Act because it is only one example for now. Federal Bankruptcy Act provides that substantive things as well as procedural things on bankruptcy. It provides on municipal bankruptcy in chapter 9. The title of chapter 9 is “Adjustment of Debts of a Municipality” and the title represents the system’s characteristics which is not for a liquidation of an municipality but for a reorganization and is achieved by an adjustment of debts. In other words, this system is a remedial measure for financial crisis of municipality and actually it made for same purpose in the middle of Great Depression. If bankruptcy court approve the petition, local government can keep administrative operating by it’s own responsibility including actions for restore financial soundness. The central government should consider its characteristics and the nature of local autonomy system which the constitution law provide when to discuss to adopt it. Namely, the adoption of municipal bankruptcy system should not violate fundamental value of local autonomy. Meanwhile, we need to analyze current financial situation of local government to know why the minister announced to adopt the municipal bankruptcy system. It means that financial situation of local government is severe. We have to determine the cause of current situation. First of all, many of municipality in korea have enough source of taxation. The revenue of taxation is under the 40% in accordance with 2014 budget. Substantial parts of revenue is depend on local subsidy. Fundamentally this structure is not stable. Besides It can be causes for financial crisis that loose management of the head of local government, too many subsidized projects which increase burden of local government, international financial crisis. Causes of financial pressure are various and complex. Therefore we have to consider if to adopt the municipal bankruptcy system is proper solution for financial crisis of local government. An adoption of municipal bankruptcy system without enough consideration can be functioned as strong means to restrain local government’s expenditure, it lead to violation of local autonomy
