이용자의 저작권 침해행위에 따른 IPTV 사업자의 법적책임

국문 초록

IPTV에 관한 ‘인터넷 멀티미디어 방송사업법’을 둘러싸고 최근 벌어진 법적 논쟁은 이전까지 저작권법이 아니라 행정법분야의 쟁점에 대한 것이었다. 하지만, 인터넷기술을 기초로 한 IPTV의 속성상 이용자들의 저작권 침해행위가 앞으로 빈발할 것이므로 이에 대비하여 IPTV사업자의 부수적 책임론을 논의하는 것이 시급히 요구되고 있다. IPTV 중 실시간 방송부분은 웹캐스팅과는 달리 현행 저작권법상 소위 디지털음성송신이 아니라 방송에 해당한다. 그리고 IPTV 중 주문형 비디오 서비스부분은 저작권법상 전송에 해당한다. 그러므로 방송이나 전송에 관한 저작권법규정이 각각의 서비스부분에 제대로 적용되어야 한다. IPTV에 포섭된 이른바 인터넷검색포털 기능이나 인터넷개인방송 기능을 통하여 IPTV이용자들에 의한 저작권침해가 발생한 경우, IPTV사업자의 책임근거는 방조에 의한 공동불법행위 법리에 의하게 될 것이다. 이 점은 다양한 인터넷 서비스 제공자들이 개입되었던 그 이전의 사례들에서와 같다. IPTV사업자가 중앙서버에 PVR저장장치를 두는 것은 셋톱박스 내장형보다 법적위험이 더 클 것으로 보이지만, 어느 경우나 이용자의 행위가 우리 저작권법상 사적복제의 예외로 인정될 가능성이 크다. PC등 다른 디지털장비에서획득한 콘텐츠를 IPTV에서도 이용할 수 있도록 해주는 디빅스 플레이어 기능을 IPTV서비스에 결합하는 경우는 특별한 사정이 없는 한 대개 침해문제가 생기지 않을 것이지만, 소위 개방형IPTV 구조의 채택은 IPTV사업자의 책임을 인정하는 근거 중의 하나로 참작될 수는 있다. 끝으로 온라인서비스제공자의 책임제한조항은 단지 전송행위만을 포섭할뿐 IPTV사업자의 실시간 방송행위는 포함되지 않는다는 것이 합리적인 법해석이겠지만, 방송행위에까지 위 책임제한 조항이 적용될 수 있도록 저작권법을 장차 개정함이 타당하다고 본다.

영문 초록

The recent legal debate concerning the Internet Multimedia Broadcasting Service Act dealing with IPTV had been about the issues in not copyright but the administrative law area. However, it is urgently needed to discuss the derivative liability rule of IPTV service provider, to cope with the users copyright infringements which will be more often owing to the nature of IPTV based on internet technology. Unlike the webcasting, the real-time broadcasting portion in IPTV service comes under not so-called the digital sound transmission but the broadcasting activity of the present Korean Copyright Act. And the Video on Demand portion in IPTV service is subject to the interactive transmission provision of the Act. Therefore, the appropriate provisions in the Korean Copyright Act should be applied to each portion. If there will be the IPTV users copyright infringement through the function of so-called Internet Search Portal or Internet Personal Broadcasting, the Joint Tort-feasors rule will be the basis for IPTV service provider s responsibility in the case. This is same as in the previous cases related to various internet service providers. Even though the IPTV service provider s legal risk of keeping a PVR depositary on the central server would be greater than the risk of keeping it in the set-top box, the user s activity in both case will probably be recognized as the exception of the reproduction for private use under the Korean Copyright Act. While there would be no infringement from the incorporation of the Dvix player function into the IPTV service, which makes the contents from the other digital devices such as PC available to IPTV, the adoption of so-called the open IPTV structure could be one of grounds for legal responsibility of IPTV. Finally, the Korean Copyright Act should be amended to make the OSP liability limitation provision applied to the broadcasting activity by IPTV service provider, though the reasonable interpretation of the provision will be that the provision includes only the interactive transmission activity, not the broadcasting activity.
