방송통신시장에서 망 중립성과 관련된 규제의 쟁점과 공정거래법의 적용가능성

국문 초록

2000년부터 미국에서 시작된 망 중립성에 대한 논의는 특히 인터넷 서비스의 발전 및 인터넷을 통한 방송통신 서비스의 융합 현상에 따라 주로 광대역 인터넷 서비스망을 중심으로 이루어지고 있으며, 우리나라에서도 또한 방송통신융합현상에 대처하기 위한 통합법안을 제정하는 분위기와 함께 그 논의가 더욱 활발하게 이루어지고 있다. 망 중립성은 그 접근 관점에 따라 다양한 의미로 사용되고 있으며, 망 중립성에 기한 규제의 필요성에 대하여도 이해관계에 따라 다양한 입장이 존재하고 있다. 인터넷 서비스망에 대한 망 중립성 논의에 있어서는 인터넷 서비스를 제공하는 ISP와 인터넷 서비스망을 이용하여 콘텐츠를 제공하는 CP, 인터넷 서비스망을 이용하여 CP로부터 콘텐츠를 제공받는 인터넷 이용자가 주요 이해관계인이 된다. ISP와 CP 및 이용자 사이에는 망 중립성에 기한 규제를 도입할 필요성 및 규제의 정도에 대하여 상당한 입장 차이를 보이고 있고, 그 외에도 대역 제어, 프리미엄 망 도입, 인터넷 종량제 도입 등 몇몇의 구체적인 쟁점에 있어 이해관계의 대립을 보이고 있다. 현재까지 망 중립성에 대한 논의는 주로 법적인 관점보다는 다분히 정책적인 관점에서 이루어져 왔다. 그러나 방송통신시장에서의 특수한 경쟁법적 쟁점을 포함하고 있다는 점, 인터넷 서비스망을 중심으로 한 이해관계인의 대립이 법적 분쟁으로 나타날 가능성이 크다는 점 등에서 망 중립성에 대한 법적인 관점에서의 접근이 필요한 것으로 보인다. 본고에서는 망 중립성에 대한 법적 관점에서의 접근을 시작하는 단계에서 망 중립성의 기본 개념과 망 중립성 논의에 있어 이해관계인들 사이의 주요 쟁점 사항을 살펴보며 또한 공정거래법의 적용가능성 및 입법화논의에 대하여 알아보기로 한다.

영문 초록

Discussions on net neutrality have developed mainly around the topic of broadband internet service networks. This is especially due to recent developments in internet service and increased consolidation of broadcasting and communication services through the internet. Discussions on net neutrality have also been enhanced in Korea pursuant to movements to enact a consolidated set of regulations to address areas of convergence in the broadcasting and communication services. The concept of net neutrality encompasses various meanings and developments depending on the approachtaken. Views on necessity for regulating net neutrality also vary greatly based on interests that lie underneath. Major parties with interests in the discussions for net neutrality in the internet service include internet service providers (ISPs), contents providers that offer contents through the internet (CPs) and internet users that utilize the contents provided (Users). The views of ISPs, CPs, and Users may differ substantially not only with regards to regulation of net neutrality but also other issues such as control of bandwidths, introduction of premium networks, and internet metering. Most discussions on netneutrality, until now, have taken place from a policy perspective rather than a legal perspective. However, taking into consideration that the discussion involves competition issues in the broadcasting and communications market and that the divergent interests regarding the internet service networks is likely to result in legal disputes a legal discussion has now become necessary. In initiation of legal discussions for net neutrality, this article aims to outline the basic concepts of net neutrality and introduce the divergent interest and disputes among major parties while also reviewing the applicability of competition laws and current prospective for legislation.
