제주자치경찰과 국가경찰간의협약사무 개선방안

국문 초록

제주자치경찰이 실시된지 벌써 5년째를 맞이하고 있다. 그동안 제주지역엔 자치경찰기 관과 제주국가경찰이 병존하여 업무를 수행하고 있다. 제주특별자치도법 제108조에서는 제주특별자치도에 자치경찰사무를 정하고 있으며, 제110조에서는 자치경찰사무를 국가경찰인 제주지방경찰청장과 제주특별자치도지사간 업무를 협약하여 처리하도록 하고 있다. 이처럼 제주에는 우리 역사상 전례가 없던 지방자치단체에 자치경찰제도를 시행하고, 특별법 에서 자치경찰사무를 정하여 권한을 부여하고 있다. 제주자치경찰이 시행되고 있다는 것은 우리 민주주의가 이제 그 기틀을 자리잡고 있으 며, 특히 지역에 부합하는 봉사자로서의 경찰행정기관을 설치하여 지역에 맞는 치안을 확립하고자 노력하고 있다. 이처럼 제주라는 한정된 지역에 자치경찰을 실시하는 것은 헌법상 지방자치의 제도적 보장을 실현하는 것뿐만 아니라 자치본연의 목적인 지역에 부합하는 행정사무를 수행할 수 있다는 것을 나타내고 있다. 제주자치경찰이 수행하는 사무는 제주특별자치도법에서 정한 사무중 국가경찰기관과 협약하여 처리하는 사무만을 제한적으로 수행하고 있는 한계를 가지고 있다. 이러한 협약사 무는 행정기관 당사자간의 의사의 합치에 의해 이루어지는 것으로 그 법적 성격이 공법상 계약에 해당한다. 국가경찰기관과 제주자치경찰이 상호맺는 협약은 대등당사자간에 맺는 의사표시로써 상호간의 협의에 의해 이루어지도록 정하고 있다. 만약 협약이 이루어지지 않을 경우 행정안전부장관이 이를 조정하도록 의무화하고 있어, 중앙행정기관인 행정안전 부장관에 결정권을 부여하는 문제를 내포하고 있다. 제주자치경찰이 본연의 업무를 수행하기 위하여는 협약사무의 존치가 과연 필요한가와그 협약사무는 기존 협의적 행정경찰에서 수행하는 사무인데 이를 과연 별도로 정하여 자치경찰이라는 미명하에 권한을 부여하는 것이 타당한가는 의문이다. 따라서 본 연구에서는 제주자치경찰과 국가경찰간의 업무협약이 가지는 문제점을 분석하고 업무협약의 개선방안을 제시하여 지역에 부합하는 자치경찰의 목적을 달성하도록 하였다.

영문 초록

It has been five years since Jeju Municipal Police was operated. During those periods both of Jeju Municipal Police and Jeju Provincial Police have done their business together in Jeju. The article 108 of Jeju Special Self-Governing Law stipulates what the municipal police should do, and the article 110 states that those works should be done under the agreements which is made between the Director of the Jeju Provincial Police and the Jeju Provincial Governor. Seen above unprecedented municipal police is carried out in Juju that has its authority guaranteed by the Special Law to do its works. The fact that Municipal Police takes into effect in Jeju shows that democracy stands firmly and the police, as volunteers suitable for local areas, makes its efforts to make sure public security. In addition, it demonstrates that the autonomy is really carried out beyond institutional guarantees on the constitution as well as it does its administrative business proper to local areas that is an original purpose of the autonomy. However, Jeju Municipal Police has its limitation, because its works should be handled according to Jeju Special Self-Governing Law stating that the works of Jeju Municipal Police should be dealt with Jeju Provincial Police under the agreement between the two. But if there is a disagreement between the both, the minister of the administration safety department is obliged to settle the disagreement. so there are some problems in giving the authority to deciding to the minister. Thus, it is questioned whether Jeju Municipal Police needs to work with Jeju Provincial Police by the agreement. It is also questionable whether the authority is appropriate that is given to consented works between Jeju Municipal Police and Jeju Provincial Police in accordance with the Special Law. This study, therefore, analyzes that problem and suggested reform measures to attain the purpose of municipal police suitable for local areas.
