국문 초록

작년 지방선거후 성남시의 지급유예선언은 하나의 헤프닝으로 끝났지만 지방재정의 건전화라는 숙제를 남겨주고 종결되었다. 이미 1990년대 말부터 시작된 적자재정에 대한 건전성 회복의 과제는 정부중심으로 모니터링되어 왔지만 2008년부터 시작된 세계적인 금융위기는 개별국가 단위의 재정부족에 대한 대책이 필요함을 절실하게 하였다. 그러나 이들 논의는 주로 대의제에 입각한 의회중심주의를 기본이념으로 하는 세부제 도의 개선에 주어져 있었다는 점에서 한계를 보이고 있다. 국민주권주의를 전제로 하면 최종재정부담은 결국은 국가 구성단위로서의 전체 국민에 돌아간다. 이러한 전제는 바로 재정민주주의가 재정통제의 전제가 되는 이념으로 자리 잡을 수밖에 없다. 이러한 재정민주주의는 과거에는 정치적인 이데올로기에 터잡은 일부 시민단체만을 위한 논의로 치부되어 왔으나 지금은 재정의 양 축인 세입과 세출을 모두 납세자의 부담이라는 점에서 실제적인 논제로 다가 와 있다. 이러한 측면에서 재정민주주의는 단순히 대의제에 입각한 간접적인 통제를 보완하는 차원을 넘어 앞으로 직접 통제하는 방안을 전면에 등장하는 형태의 논의가 이루어 져야 한다고 본다. 이 점에서 납세자기본권이라는 묶음형태의 기본권을 입론하고 새로이 논리를 전개해 보아야 할 시점이 되었다. 이러한 점에서 기존의 주민의 직접 참여 수단들을 정리하여 장래 후속논의의 기초자료를 제공하려 하였다.

영문 초록

The budget control on the typical meaning has been charged by the central government. But the moratorium declared by the SungNam city after the local election of the last year revealed as a happening but has brought a momentum to check the financial soundness of the local governments. Budget deficit control of the local governments has already begun during the IMF management periods in the late 1990s, but the central government was mainly responsible for that control. On the contrary the global financial crisis in 2008 required as much systematic monitoring on the budget of the each local government. However, the detailed measures for monitoring which were reinforced by the central and local governments for the recent 2 years were based mainly on parliamentary representative democracy. That is why these measures show the limits when observed from the principle of national sovereignty. Under the premise of national sovereignty, the ultimate financial responsibilities were attributed to the whole residents as a local government’s governance unit. That means the finance democracy must be taken as the ideological premises of the financial control. The finance democracy which was regarded as the political ideology only for some NGOs in the past, is to be a practical agenda because the taxpayers have the burden to meet the both sides of the public finance, revenues and expenditures. In these aspects, further discussions will be needed how to place in front the direct control measures by the residents, although the discussions of the past about that were simply stay on the level of the complementing the indirect policies. Now it’s time to establish the logic of finance democracy newly, especially remodelling the basic rights of taxpayers as the concept of ‘bundles of rights’ in this respect. It is my attention to categorize the existing means of the direct participations of residents to the finance deficit control of the local governments in this sense and how to improve these policies and specified means in this thesis.
