지방자치단체 거버넌스위원회 설치 및운영에 관한 연구- 김해시의 사례를 중심으로 -

국문 초록

오늘날 우리 사회는 정치 경제 사회 문화적 환경이 거시적으로 변모함에 따라 행정 현상도 큰 변화를 보이고 있다. 즉 행정의 역할이 전통적인 권위주의적 통치자에서 벗어나 관리자 협력자로 전환되고 있다. 또한 시민의 역할은 과거의 행정객체에서 대등한 주체로 변화되었다. 1990년대로 접어들어 자치단체장과 지방의원을 지역 주민이 직접 선출하는 지방자치제가 본격적으로 실시됨으로써, 지방의 정치 행정에 대한 주민참여가 괄목할 정도로 확대되었다. 이상과 같이 행정의 의사결정구조의 변화는 거버먼트(government)에서 거버넌스(governance) 로 이행 중이라 할 수 있다. 즉 현대사회가 역동적으로 변모 발전하는 시대상황에 따라 전통적인 상명하달식의 계층제와 관료제 정부형태만으로는 복잡한 사회문제에 신속하고 효율적으로 대응할 수 없을 뿐만 아니라, 대안을 제시하는 데에도 한계에 부딪힐 수밖에 없다. 따라서 정부 간 관계뿐만 아니라 다양한 주체들 상호간에도 유기적 협력관계를 강조 하는 거버넌스가 대두하게 된 것이다. 거버넌스의 핵심적인 요소라 할 수 있는 각 주체 간의 상호 협력적 관계의 형성을 통해, 지금까지의 ‘정부실패’와 ‘시장실패’를 해소하여 정부가 수행하는 공공정책의 효율성과 민주성 및 실효성을 확보하기 위해서는 주민, NGO, NPO, 기업, 학교, 언론 등 다양한 주체가 정책형성과정이나 사업시행에 참여하여 강력한 파트너십을 형성하는 일이 보다 강하게 요청된다. 그런데 지난 2010년 6 2 지방선거에서는 다수 지역에서 야당과 지역의 시민사회단체들이 후보 단일화를 통해 선거에서 승리할 경우, 후보 단일화에 동의한 각 주체들이 함께 참여하여 ‘자치단체 거버넌스위원회’를 구성하기로 합의하게 되었다. 김해시에서도 지역 야당들과 시민사회단체들이 시장후보 단일화 과정에서 자치단체 거버넌스위원회의 한 유형 이라 할 수 있는 ‘민주시정협의회’의 구성에 합의하였으며, 단일화된 야당 후보가 시장에 당선되었다. 이상과 같은 배경을 토대로 선거가 끝난 이후, 지역에서는 소통과 화합의 장으로서 거버 넌스위원회 구성이 제기되었고, 실제로 그 구성 운용을 위한 노력들이 펼쳐지고 있다. 그런데 지방자치단체와 시민사회단체 및 지역의 다양한 정치세력들이 참여하는 자치단체 거버넌스위원회의 설치 운영을 위해서는, 그러한 위원회의 성격을 법리적으로 분석하고 그 설치 운영을 위한 법적 근거가 마련되어야 할 것이다. 하지만 최근 제기되는 자치 단체 거버넌스위원회를 설치 운영해본 경험이 없으므로, 자치단체 거버넌스위원회의 설치를 위한 법적 근거와 바람직한 위원회 운영방안에 관한 연구가 시급한 실정이다. 따라서 본 연구는 지난 6 2 지방선거 이후 각 지방자치단체에서 제기되고 있는 지역 거버넌스의 일환으로서의 ‘민주시정협의회’의 구성에 필요한 법 이론적 토대를 제공하고, 그 바람직한 운영을 위한 합리적인 방안을 모색하려는데 목적이 있다.

영문 초록

Today, depending on the macroscopic changes of our society in political, economic, social and cultural aspects, phenomenon of the administration were also greatly changed. In other words, the role of government is changing into administrators or collaborators, away from the traditional authoritarian rulers, In addition, the role of citizens turned to the owner of administration, away from the object of administration in the past. In the 1990s, according to the introduction of local government institutions that mayors and municipal council members are elected by local residents, Residents are involved in the politics and administration of local governments. As mentioned above, the administrative decision-making structure has turned from government into the governance. In other words, according to the dynamic transformation and development of modern society, the traditional hierarchical and bureaucratic form of government alone can not respond quickly and efficiently a complex social problem, but also can provide an appropriate alternative to complex social problems. Thus, as well as the relationship between the government and the government, and even among various actors, governance that emphasize the organic relationship there were appeared. Through the formation of collaborative relationships between each participant, which is an important element of governance, residents, NGO, NPO, companies, schools, media and the various parties have to involve in the policy formation process and project implementation to overcome ‘government failure’ and ‘market failure’, and to perform the public policy of the government and democratic efficiency and effectiveness. However, last June 2, 2010, there were local elections. In many areas, the opposition parties and local civil society organizations agreed on a single candidate. And they agreed to make the governance committee of local government, if they win the election. Based on the above background, they proposed to the governance committee as a forum for communication and reconciliation in many areas after the election. The And also here are trying to establish the commission. However, in order to establish and operate a governance committee, local governments and civil society organizations and a variety of local political parties have to analyse the nature of the committee, and a legal basis of the establishment and operation of the committee. Therefore, the author research to provide legal and theoretical foundation, and the good operation of the committee.
