국문 초록

「지적재조사에 관한 특별법」 제14조는 지적재조사사업에 관한 핵심규정이라고 할 수 있다. 지적재조사사업의 목적이 지적불부합지의 정리에 있기 때문에 이를 해결하기 위한 경계설정기준은 지적재조사 사업의 성패를 좌우하는 중요한 요소이다. 그러나 「지적재조사에 관한 특별법」 제14조의 경계설정기준은 그 적용상에 모순이 있을 뿐만 아니라 내용상으로도 불분명한 부분이 적지 않다. 본 연구는 지적재조사 사업의 원활한 진행을 위해 「지적재조사에 관한 특별법」 제14조의 적용상ㆍ내용상의 문제점을 제시하고 그 해결방안을 모색하였다.

영문 초록

Article 14 of Special Act on Cadastral Resurvey is the key provision on Cadastral Resurvey Project. As the objective of Cadastral Resurvey Project is the elimination of cadastral inconsistency land, the rule of land boundary demarcation to eliminate cadastral inconsistency land is the important factor to determine the success or failure of Cadastral Resurvey Project. However, the rule of land boundary demarcation in Article 14 of 「Special Act on Cadastral Resurvey」 has inconsistency in the application of the Act and unclear contents. This study explains inconsistency in the application and unclear contents in Article 14 of 「Special Act on Cadastral Resurvey」 and suggests solutions in order to carry on smoothly Cadastral Resurvey Project.
