국문 초록

학업성취도 평가는 전문적인 판단을 요하는 것이며, 외적인 규제나 통제와는 거리가 멀다. 그러나 학업 성취도 평가에 대한 실시와 방법 등에 대한 주요 내용은 법에 근거를 두고 규제하는 상황에서 이루어지고 있다. 이 연구는 이러한 관계를 살펴보기 위해 학업성취도 평가 분야에서 제기되는 법적 문제를 다루어 이론적으로 해결되거나 정비되어야 할 부분을 알아보고자 한 것이다. 논의 결과 공교육 체제에서 국가는 학업성취도 평가의 기준을 설정하여 학업성취도 평가에 관여할 수 있는 권한이 있고, 교사는 이러한 기준 의 범위 내에서 내용적인 면을 판단하여 기술할 수 있는 권리를 지니고 있었다. 그래서 학습자의 성장에 봉사하고, 주체적인 자기형성을 기하는 평가의 본래 목적을 달성하는데 노력하여야 했다. 그러나 아직 우 리나라의 학업성취도 평가 관련 규정은 국가의 권한이 강화되어 있고, 교육외적인 학업성취도 평가가 현 실적으로 규제하고 있어 교육의 본질을 구현하는데 문제가 노출되어 있었다. 그래서 향후 이러한 부분에 대한 판례의 분석과 이에 따른 이론적 정립을 통해 법과 제도를 정비하여야 할 과제가 있었다.

영문 초록

The evaluation of the scholastic achievement of students that needed professional judgement must be done in atmosphere of freedom. But, the main contents of the evaluation of the scholastic achievement of students are prescribed by laws and rules. Nevertheless, the reason that the evaluation of the scholastic achievement of students is a subject of discussion of legal study does protect some rights for learning by prescribing rules of human resources and material conditions. However, a study on the legal aspects related to the evaluation of the scholastic achievement of students was not conducted properly. Therefore this study dealt with the legal problems of the evaluation of the scholastic achievement of students. This study worked three topics: the educational freedom of school teachers, the power of government, and methods of evaluation in the evaluation of scholastic achievement of students. As a result, while the power of government strengthens, the educational freedom of school teachers remains week. Therefore, there needs to be modification of laws and institutions for the establishment of autonomy in the evaluation of the scholastic achievement of students.
