범죄피해자구조금의 회수를 위한 구상권행사 제도의 개선방안

국문 초록

범죄피해자 보호법에서는 피해자구조금제도를 법제화하고 있다. 이것은 헌법 제30조에서는 “타인의 범죄행위로 인하여 생명･신체에 대한 피해를 입은 국민은 법률이 정하는 바에 의하여 국가로부터 구조를 받을 수 있다.”고 규정하고 있는 것을 구체화한 것이다. 특히 2010년 범죄피해자 보호법의 전부개정에서 구조금 지급요건이 완화되고, 구조대상이 범죄로 인한 사망과 모든 장해 및 중상해를 입 은 경우까지 확대되면서 피해자구조금의 신청이 대폭 늘어났으며, 따라서 지급된 피해자구조금도 대폭 증가하였다. 피해자구조금은 벌금 집행액의 일부(6%)로 편 성된 피해자보호기금을 통해 지급되고 있지만 피해자보호기금은 벌금 총액에 따 라 변동될 수밖에 없기 때문에 불안정한 상태이다. 따라서 피해자에 대한 효율적 인 경제적 지원을 위해 안정적인 재원마련 대책이 요청되는 한편, 기 지급된 피 해자구조금의 회수를 위해 가해자에 대한 구상권행사의 필요성이 증대되고 있다. 하지만 2011년부터 2013년 상반기까지의 구조금 집행금액 약 150억원 중에서 구상 권행사를 통해 범죄피해자보호기금에 편성된 구상금은 10%(15억원)에 불과하다. 이에 본고에서는 가해자에 대한 국가의 구상권행사에 관한 법적 근거와 필요성 에 관해 고찰하고, 현행 구상권행사제도의 문제점을 살펴 본 후, 효율적인 구상권 행사를 위한 개선방안을 제시하였다. 구체적인 개선내용으로는 구상권행사를 위 한 독립조직의 구축 및 전문인력의 확보, 관련업무규정 및 매뉴얼의 작성, 구상권 행사의 실효성 확보를 위한 사전제도의 마련, 구상권행사를 위한 국가의 적극적 인 노력, 관련부처 간 업무협력의 강화, 구조금 회수에 관한 법규의 보완 등을 제 시하였다.

영문 초록

is an act that gives shape to Art. 30 of Constitution of the Republic of Korea : “Citizens who have suffered bodily injury or death due to criminal acts of others may receive aid from the State under the conditions as prescribed by Act”. Especially, as the condition to pay the aid fund is relaxed and the range of the aid fund payment is expanded up to the death, and every disability and secure injury caused by crime by the general revision of Crime Victim Protection Act in 2010, the application of crime victim aid fund by crime victims increased sharply. Therefore, the amount of crime victim aid fund which is payed to victims also increased drastically. Due to this, it is operated in a way that parts(6%) of the money which is get from the fine enforcement is used as crime victim protection fund. However, because this protection fund can be changed with the total amount of the fine, this protection fund is in a unstable condition. Thus, to provide economical support to criminal victims effectively, an establishment of system for securing the stable financial resources of this protection fund is required and on the other hand, with the purpose of the collection of the crime victim aid fund which was already payed, the necessity of the exercise of the right to indemnity toward a perpetrator is also increasing. But, in periods of between in 2011 and in the first half of 2013, the money which the nation was planned to collect from perpetrators by the exercise of the right to indemnity was nothing but 10%(1.5 billion won) of the budget drawn to crime victim protection fund(around 15 billion won). Hence, in this paper, after considering the necessity and the legal basis of the exercise of the right to indemnity toward a perpetrator, I examined its problems and suggested rational improvements to resolve them. The specific improvements I suggested are as follows: the establishment of the independent organization for the exercise the right to indemnity and the securement of professional staffs, the making of the regulations and the manual for works as to the exercise of the right to indemnity, the preparation of the prior measures for achieving effectiveness of the exercise of the right to indemnity, the nation’s active endeavor to exercise the right to indemnity, the reinforcement of the cooperation among the authorities which is related to works about the exercise of the right to indemnity and the supplementation of the legislation as to the collection of crime victim aid fund etc..
