유럽인권협약 제14의정서에 의한 사법감독제도의 개혁

국문 초록

2004년 5월 13일, 유럽평의회는 “(유럽인권)협약의 감독제도를 수정하는 인권 및 기본적 자유의 보호에 관한 유럽협약 제14의정서”을 채택하고, 유럽인권협약 의 사법감독제도를 전면 개편하였다. 첫째, 3명의 판사로 구성되는 위원회, 7명의 판사로 구성되는 소재판부와 17명 의 판사로 구성되는 대재판부와 함께 단독판사를 신설하고 있다. 둘째, 일부 제소의 본안심리를 하는 간이절차가 도입되었다. 셋째, 개인 제소의 심리부적격에 대한 새로운 기준이 도입되었다. 이 기준에 의 하면 제소자가 상당한 불이익을 받고 있지 않는 한 제소는 각하된다. 마지막으로, 판결의 이행 감독 권한은 유럽평의회 각료위원회에게 있다.

영문 초록

May 13, 2004, the European Council adopted the “Protocol No. 14 to the Convention for the Protection of Human Rights and Fundamental Freedoms, amending the control system of the Convention”, and reorganized the judicial control system of the European Convention on Human Rights. First, the European Court of Human Rights(ECtHR) sit in a single-judge formation, in committee of three judges, in Chambers of seven judges and in a Grand-Chamber of seventeen judges. Secondly, simplified procedure was introduced to decide on merits of individual applications. Third, the new inadmissibility criteria was introduced in individual application. According to this criteria, the individual application will be rejected if the applicant has not suffered a significant disadvantage. Finally, the competence of implementing the final decision by the ECtHR depends on the Committee of Ministers of the Council of Europe.
