도시계획재량의 투명화에 관한 고찰

국문 초록

재량이란 법이 부여한 범위 내에서 행정청이 선택ㆍ결정할 수 있으며 위법하지 않아야 하는 행위이다. 이는 행정에 필수불가결한 것이며 인정과 통제에서 양면성을 지닌다. 특히나 여러 행정계획 중에서도 처분성과 구속성을 가지는 도시계획은 계획 자체가 가지는 다양한 결정 가능성과 미래의 불확실성으로 인한 형성의 자유와 형량명령의 특수한 성질로 인하여 재량이 많이 부여 되었다. 이를 통제하기 위해서 투명화가 필요한 것이다. 투명화는 단순히 깨끗함을 의미하는 것이 아니라 법을 근거로 한 해결방안이라고 할 수 있다. 법률유보에 의한 법치주의와 민주주의를 통한 시민의 참여가 대표적이다. 이를 통해 도시계획의 수립ㆍ결정 주체의 재량 행사상의 문제점을 절차법적, 체계적, 실체법적으로 나누고 이에 대한 투명화 방안을 모색하였다. 그 방안으로는 도시계획의 절차법을 제정하여 사전의 통제와 법적 근거를 마련하자는 것, 실질적인 권한을 가진 도시계획위원회의 통제방안, 도시계획 관리시스템의 도입, 재량준칙의 기준의 명확화, 처분성과 사법통제에 따른 형량명령의 명문화화 확대 방안 등을 제시하였다.

영문 초록

A discretion is an action which an administrative agency can choose or decide on within the scope granted by the law and an action should not be violated. This is essential to administration, and has a double-sidedness in terms of acknowledgement and control. Especially, among various administrative plans, urban planning that has both disposability and restriction is given a lot of discretions due to its special characteristics in terms of the freedom in formation and the sentence commands derived from uncertainty in the future and various possibilities in decisions that the planning itself has. To control this, transparency is required. Transparency does not simply refers to clarity, but it can be said a resolution based on laws. Constitutionalism by statutory reservation and participation of citizens through democracy are representative of this. In this way, the issue on executing discretion by the principal agent of establishing and determining urban planning was studied by dividing the issue with regards to: procedural laws; systematic laws; and substantial laws, where it was groped for ways towards transparency. For such ways, the recommendations include: preparation of legal grounds and controls in advance by establishing procedural laws for urban planning; introduction of urban planning management system; clarification of standards for discretionary regulations; plans for expanding stipulation for priority between public interest and private due to judicial controls and disposability.
