노인주거권에 관한 법적고찰

국문 초록

점차 증가하는 노인인구로 인하여 대한민국의 고령화는 매우 빠른 속도로 진전되고 있어, 2018년에는 노인인구 비율이 14.3%로 고령사회에 진입할 예정이다. 우리나라 통계청은 2019년에 고령사회에, 2026년에는 초고령사회가 될 것이라고 전망하고 있는데 이는 고령화 사회에서 고령사회로 가는 데 19년, 고령사회에서 초고령사회로는 불과 7년밖에 소요되지 않는다는 것을 뜻한다. 노인 인구증가와 함께 노인의 경우 소득활동으로 인한 소득의 수준이 낮고 거주하는 주택의 노후, 가족구조와 자녀들의 노부모의 부양책임의식의 저하 등의 문제 때문에 더욱 노인주거권에 대한 문제점이 대두되며 이를 해결하고자 하는 관심도 커질 수밖에 없다. 이에 따라 본 논문은 노인주거권에 대한 법적근거에 대하여 고찰하고 현재 노인주거와 관련하여 시행중인 "장애인ㆍ고령자 등 주거약자 지원에 관한 법률"에서 규정하고 있는 주거약자용 주택의 최저주거기준 및 편의시설설치기준 등을 설정ㆍ공고하도록 하고, 일정 요건을 충족하는 건설임대주택의 경우 일정비율 이상을 주거약자용 임대주택으로 건설하도록 의무화하며, 주거약자용 주택으로의 개조 비용을 지원할 수 있도록 하는 등 주거약자 지원 방안에 대한 문제점과 개선방안을 제시함으로서 향후 노인 주거안정과 복지를 실현하는데 기여하고자 한다.

영문 초록

Aging in the Republic of Korea is being progressed at a very fast speed owing to the gradually growing elderly population. Thus, the ratio of elderly population plans to enter the aged society with 14.3% in 2018. Our country's national statistical office is prospecting that it will be aged society in 2019 and super-aged society in 2026. In case of the elderly along with a rise in elderly population, the income level caused by income activity is low. Owing to problems about deterioration in a house of being dwelt and about a drop in children's consciousness of filial responsibility for old parents in addition to family structure, the issue on the elderly housing right is further emerged. Even an interest in aiming to solve this cannot help getting bigger. Accordingly, this study aims to examine about legal ground on the elderly housing right and to contribute to realizing the elderly residential stability and welfare henceforth by suggesting problems and improvement plans for a method of supporting a residentially underprivileged group such as making it established and announced the minimum housing standard and the convenient-facility installation standard of housing for a residentially underprivileged group, which are being prescribed in "law on supporting a residentially underprivileged group such as the disabled and the aged" of being enforced now in relation to elderly residence, as making it compulsory for rental housing of satisfying the certain requirements to construct more than the fixed ratio as the rental housing for a residentially underprivileged group, and as making it possible to support the renovation cost into housing for a residentially underprivileged group.
