민주공화국에서 의무적 투표 참여제의 합헌성

국문 초록

우리는 '선거'를 통해서만 대표를 선출한다. 대의제하에서 대표가 될 수 있는 방법은 선거를 통한 당선뿐이다. 선출된 대표에게는 선거권자의 의사와는 다르게 정책을 결정할 수 있는 자유위임이라는 엄청난 힘이 주어진다. 그런데 88년 대통령 직선제 개헌과 두 차례의 여야 정권 교체 이후에 대표를 선출하는 선거에 참여하는 선거권자의 비율은 유의미할 정도로 낮아지고 있다. 국회의원과 지방의원의 재ㆍ보선 선거의 투표율은 20~30%에 머물기도 한다. 그간 선거권은 자유주의적 관점에서 권리의 영역에만 머물러 선거권자가 투표하지 않는 것은 그들의 자유로운 선택이었고 포기할 수 있는 권리일 뿐이었다. 투표하지 않는 자에 대한 어떠한 종류의 제재도 선거권자의 자유를 제약하는 부정적인 것으로 취급되었다. 그러나 공화주의적 관점에서 선거권은 권리이자 의무이다. 공화국의 대표를 구성하기 위한 선거에 참여하는 공화국 구성원의 덕성(virtu)은 성공적 대의제 운영의 전제 조건이기 때문이다. 대한민국은 공화국이고 공화국은 생래적이고 단순한 '모임'이 아니라 법의지배, 이익공유 등의 가치에 동의한 정의와 공공복리 추구를 목적으로 결속한 인민(people, populus)의 일(res)이므로 보다 나은 공화국을 위한 투표 참여의 강제는 가능하다.

영문 초록

We can select the representatives only through 'election' and being the represent should be through 'election'. the 'elected' representatives are entitled with the free-entrusted position to decide the policy against the will of the electors. After constitutional revision of direct presidential election in 1988 and two times of regime changes between the Government and the Opposition parties, turnout of votes have been significantly light in the election to select the representative. A turnout for the by-election to select the members of for National Assembly stays around 20-30% only. The voting rights only stayed in the part of "Rights" by liberalism and voters not casting votes were their free choice and 'boycott'-able rights. Any kind of sanctions for the voters that don't vote are considered negative in restricting their freedom. By republicanism, however, voting rights are liabilities as well as rights. "Virtu" of republic members to participate "election" to constitute the representatives are prerequisites for successful representative system. Republic of Korea is a republic and it's not simple gathering or group but "res" of "people/populus" gathered to pursue justice and public well-being in belief of rule by law, sharing of interest which allows coercion for votings for the interest of republic.
