기간계산규정의 법해석과 재판을 받을 권리의 보장

국문 초록

개인의 권리는 일정한 기간을 두고 보장된다. 이것은 법이 추구하는 진정한 권리자의 보호와 법적 안정성의 보장이라는 두 가치의 축으로부터 나온다. 그러므로 국민의 법적 관계에서 기간의 문제는 매우 중요하기 때문에 규범에 명확하게 규정되어야 한다. 기간의 규정방식과 그에 대한 해석은 분쟁 당사자의 권리발생, 변경 그리고 소멸의 효과와 관련되어 있으므로 통일적인 원칙 아래 이루어져야 하고, 당사자의 귀책사유 등의 존부에 대하여 공정하게 평가하여야 한다. 이와 같이 기간은 특히 법원에 대한 국민의 접근 가능성의 측면에서 유리하게 또는 불리하게 작용하기도 한다. 기간의 경과 여부에 대한 논쟁은 법원을 통하여 해결될 수밖에 없는데, 이에 대하여 법원은 공정한 원칙과 법적 이성에 토대를 두고 국민의 재판을 받을 권리를 최대한 보장할 수 있도록 해석하여야 한다. 기간의 해석에 대하여 법원(헌법재판소)은 위와 같은 법적 의무를 부담함에도 불구하고 기간계산의 오류나 착오 등으로 국민의 재판을 받을 권리나 평등권을 때로는 침해하기도 한다. 그 중에서 (법정) 공휴일에 대한 법적 이해의 부족이나 단순한 계산착오로 공휴일의 말일계산에서 비롯하는 경우가 있다. 하지만 이 경우에 국민이 국가배상이나 재심 등을 통하여 권리를 구제받을 가능성은 희박하고, 현행 사법제도의 체계상 법원의 재판작용에 의한 기본권 침해는 더욱 구제의 길이 봉쇄되어 있다. 그래서 이 글에서 이러한 구조적 문제점을 사례를 통하여 보여주고자 한다.

영문 초록

The rights of individuals are guaranteed within a given period of time. This guarantees both true holders of rights and legal stability which law seeks. Within this context, time period in legal relation of citizens is so important that it should be distinctly provided by law. As calculation of time period and its interpretation are related to arising, change and extinction of a right of disputing party it should be fulfilled under a unified principle. A fair assessment on the existence of attributable reasons of disputing party should be made as well. Time period especially effects both positive and negative way in the aspect of citizens' accessibility to court. Debating on expiration of time can only be solved through a trial. Court's interpretation should be made in ways ensure citizens' rights to trial as far-reaching as possible based on fair principles and legal rationality. Although the court or Constitutional Court owe such a duty upon interpretation of time, the court sometimes violates rights to trial or rights to equality of citizens due to time calculation errors and mistakes which are caused by short in understanding or a simple miscalculation on a legal holiday. Citizens have only bare chance to relief their rights through state compensation or retrial in such cases. Moreover, under a current legal system, it is almost completely blocked to be relieved when basic human rights of citizens are violated by judicial action. Accordingly, this study points out the systematic problems through a case.
