국가의 미래세대보호의무 실현을 위한 입법론적 연구

국문 초록

헌법을 일종의 사회계약인 세대간 계약(Generationenvertrag)으로 이해할 경우, 국가는 현재세대와 미래세대는 묵시적인 동의 아래 장기적인 헌법질서를 유지할 세대간 공동체(Intergenerational community)의 토대가 된다. 따라서 국가의 지속가능한 발전이라는 헌법적 근본목표는 국가와 헌법을 성립하게 만드는 내재적 도그마로서 모든 입법자를 구속한다. 이에 따라 현재세대는 미래세대에게 발생한 위험과 리스크를 사전에 예측하고 그 부담을 최소화 하여 미래세대의 헌법실현기회를 보장해야 할 적극적 의무를 지며, 미래세대는 현재세대의 헌법수호노력을 인정하고 부담을 수인해, 장래 도래할 민주적 의사결정 과정에서 현재세대를 배척하지 않을 의무를 진다. 현재세대가 미래세대의 이익을 미래지향적 의사결정과정에 속에서 가장 구체화 할 수 있는 국가의 영역은 '입법'이라 할 수 있기 때문에, 세대간 이익을 조정할 수 있는 가장 효과적인 과정은 입법절차라 할 수 있다. 따라서 미래세대보호의무를 실현할 수 있는 효과적인 입법대안으로 언급할 수 있는 것은 먼저 입법부내 '미래세대위원회'의 설치이다. 이어서 입법적 흠결로 인해 미래세대의 부담을 늘이지 않기 위해 입법을 보다 합리화 하고 과학화 하는 방안으로 입법평가제도의 도입을 고려해 볼 수 있다. 이를 통해 세대간 정의를 고려하는 입법절차를 지향함으로서 보다 장기적인 관점의 지속가능한 발전을 이룩해야 할 것이다.

영문 초록

If the Constitution is understood as a intergenerational contract (Generationenvertrag), a kind of social contract, a nation becomes the foundation for integenerational community to keep long-term Constitutional order under the implied agreement between present generation and future generation. Therefore the Constitutional fundamental goal of a nation's sustainable development is an internal dogma making a nation and its Constitution establish, so the goal binds the all legislators. So the present generation has active duties to expect dangers and risks to be happened in the future generation, to minimize the burdens and to secure the opportunity for the future generation's constitution realization, and the future generation has the duties to admit the present generation's efforts keeping the constitution, and to receive the burden, and not to exclude the present generation during the coming democratic decision process. As the national field for present generation to specify the future generation's profit in the most detail in future-orienting decision process is the 'legislation', so it can be said that the most effective process to coordinate integenerational profits is the legislation procedure. Therefore, as a proposed legislative alternative to realize the protection duty for future generation, the 'Future Generation Committee' in the legislative body can be preferentially mentioned. And then, it can be considered to introduce the legislation assessment system as the way making the legislation more rational, scientific in order not to increase the future generation's burden due to any legislative flaws. Through such legislative alternatives, it should be realized a nation's sustainable development to realize intergenerational justice.
