사회환경 변화에 대응한 경찰의 교통안전을 위한 법집행 방안

국문 초록

우리 경찰은 국가경찰이라는 단일화된 제도화에 경찰사무를 포괄적으로 수행하여 오고 있었다. 그러다가 제주자치경찰이 시행되면서 새로운 전환을 맞이하게 되었으며, 특히 민간경비의 시장 증가도 공행정이 수행하던 업무에 대하여 민간시장이 개입하게 되는 계기를 맞이하고 있다. 이러한 시점에서 경찰의 법집행 업무에 대한 변화가 필요하다. 또한 우리와 비슷한 체제를 가지고 있는 일본의 경찰제도상의 경찰업무에 대한 분석을 통하여 향후 자치경찰 도입 등에 따른 경찰의 역할 방향을 고찰할 필요가 있다. 사회환경변화에 따른 교통안전확보를 위하여 경찰의 법집행은 첫째, 권력적인 작용보다는 지역의 실정에 부합하는 방향이 비권력적인 작용으로 나아가야 한다. 권력적인 작용은 규제에 의하여 일시적인 효과를 발생할 수 있으나 장기적인 관점에서 보면 이는 효과를 발하지 못하는 한계를 내포하고 있다. 따라서 비권력적인 경찰지도를 통하여 안전한 교통문화를 달성할 필요가 있다. 둘째, 경찰환경의 변화에 따라 경찰제도 또한 지역의 실정에 맞는 자치경찰제도로 변화되어야 한다. 자치경찰은 지역의 실정에 부합하는 교통안전을 위한 지역적 특성을 반영할 수 있다. 지역적 특성에 따른 교통안전정책과 집행은 안전한 교통환경을 확보할 수 있다. 그리고 교통안전시설물에 대한 설치와 관리권자를 지방자치단체로 일원화 하여 법집행의 효율성과 책임성을 달성할 필요가 있다.

영문 초록

Korean policemen have been performing comprehensive affairs under the unified system of the national police. However, it faces a turnabout as Je-ju self-governing police put into operation. Private security is especially possible to be included in the affairs done by public administration that will cause an increase in private security market. In this point, law-enforcement affairs of the police need to be changed. In addition, by analysing the affairs of the Japanese police that are similar to Korean's, we should insight into predictable roles of the police which results from introducing autonomous police in coming years. To make secure traffic safety responding to shifting social situations, the law-enforcement of the police should be the following; First, it should be suitable for regional conditions in an non- authoritarian way. Authoritarian operations contain a limitation that might be effective temporarily but not in a long term. Thus, the police should achieve a safe traffic culture through a non-authoritarian method. Second, according to a shifting social environment, police system should be changed into self-governing police system that is more proper to regional actual situations than that of the current police. Autonomous police could reflect regional characteristics which are suitable for regional conditions. By doing that, Korean police could attain a safe traffic environment. Finally, in order to obtain effectiveness and responsibility of the law-enforcement by the police, it is necessarily that installment and management of traffic safety facilities should be unified.
