박근혜 정부의 경제 민주화를 위한 공법적 과제

국문 초록

박근혜 정부가 2013년 2월 25일 출범하는 데 따라 경제 민주화를 실현하기 위한 공법적 과제를 모색해본다. 경제 민주화는 경제면에서 자유와 평등을 어떻게 조화를 이루며 발전시켜 나갈 것인가에 초점이 맞춰져 있다. 경제 자유는 헌법 제119조 제1항의 규정과 같이 국민의 경제상 자유와 시장경제를 기본으로 한다. 경제 자유는 소유권과 계약의 자유, 영업의 자유, 기업의 자유 등을 내용으로 한다. 경제 평등은 제2항과 같이 경제상 기회균등과 국민 생활의 균등한 향상을 추구하는 것이다. 그러나 자본주의의 속성 상 독과점의 폐해가 상시화하고, 양극화가 심해지고 있다. 최근에는 대기업의 골목상권 진출뿐 아니라 대기업과 중소기업의 불공정 거래, 근로자의 노동3권의 약화, 소비자 피해 증대 등 구조적으로 문제점이 확산되고 있다. 이에 대한 반발로 대기업집단의 개혁요구가 봇물처럼 쏟아진다. 대기업집단, 거대경제세력과의 관계에 있어서의 평등한 기회보장과 이들의 막강한 경제력의 견제장치가 요구되는 것이다. 게다가 우리나라는 자본주의 발달과정에서 정부의 강력한 지원을 받으며 기업들이 성장하게 됐다. 이에 따라 국가권력으로부터의 경제 자유에 대한 욕구 또한 큰 실정이다. 산업화와 민주화를 압축적으로 이룩한 만큼 이를 질적으로 발전시켜야 할 필요성도 동시적으로 대두되고 있다. 박근혜 대통령이 선거 과정에서 제시한 경제 민주화 공약을 경제 자유와 평등면에서 분류를 해본다. 경제 자유는 기업활동의 규제 완화를 비롯해 출자총액제한제와 순환출자금지 논쟁, 금산분리강화, 기업집단규제법 제정 여부, 대기업 총수의 형사처벌 강화 등을 중심으로 확대 방안을 입법적으로 살펴본다. 경제 평등은 양극화 해소를 필두로 일자리 창출과 경제적 약자의 보호, 노동 민주화, 공정거래 제도화, 중소기업 적합 업종제도 강화 등을 통해 확충하는 제도적 방안을 모색한다. 자유와 평등은 늘 긴장관계에 있다. 그것은 어디까지나 '자유 속의 평등'이지 '평등 속의 자유'는 존재하지 않는다. 박근혜 대통령의 경제 민주화는 시장경제질서를 확립하면서 단계적으로 추진하자는 것이다. 헌법과 공법 질서에 맞게 추진하려고 한다. 이에 비해 민주통합당은 대기업집단의 개혁과 규제, 공정 분배에 더 주안점을 두면서 전면적으로 추진하려는 입장이다. 이 같은 차이를 극복하며 개별 경제주체들이 협상하며 타협하고 제도적으로 정비해나가야 한다. 대한민국이 지속가능한 성장을 이루기 위해서는 경제 민주화를 공법적으로 완비해나가야 할 과제를 안게 된 것이다.

영문 초록

To cope with the start of Park Geunhye Government on February 25, 2013, I try to search the task of public law to realize economic democracy. Economic democracy is focused on balancing and developing liberty and equality on economic sides. Economic liberty is based on people's economic liberty and market economy according to constitution law clause 119 1st. Economic liberty includes property right and contract, business, corporate liberty etc.. Economic equality follows after economic opportunity equality and equal upgrade of people's life according to clause 119 2nd. But there happens usually monopoly's evil influence and polarization is more deepening from the nature of capitalism. So the demand for big enterprise group's reform is pouring out. In relation of big enterprise group or big economic power the security for equal opportunity and checking system should be demanded. Moreover enterprises are growing up with the full support of government in the course of capitalism development. So the demand for economic liberty from nation power becomes more larger. We have achieved industrialization and democratization compressively. Therefore we must develop them simultaneously. I try to classify economic democracy promises of president Park Geunhye into economic liberty and equality. I try to search the policy to broaden the economic liberty in deregulation of enterprises and debating for restriction of investment gross amount and circulation investment, strengthening of separation between banks and industry enterprises, establishment of enterprise group regulation law, strict enactment of punishing CEOs of big enterprises etc.. And I try to find out the methods to expand economic equality in solving polarization problem and creating jobs, protecting economic poors, democratization of labour, institution building of fair trade and the small-medium enterprise optimization business. Liberty and equality are always at strained relation. It must be the equality in the liberty but not the liberty in the equality. President Park Geunhye will enact economic democracy step by step building market economic order. In other hand Democratic United Party will seek the reformation of big enterprises and focus on fair distribution. Therefore we must talk and coordinate, complete economic democracy and legislate in public law.
