국문 초록

2005년 민간조사 관련 법률안이 국회에 제출한 이후 지난 10여년간 민간조사법 제정 및 민간조사업 합법화에 대한 논의가 계속해서 진행되고 있다. 특히 민간조사의 업무범위에 관해서는 사생활 침해 및 인권침해 가능성에 대하여 법규정의 강화 등이 정비되어야 할 것이다. 최근 들어 개인정보 보호와 관련된 주요 사건들이 발생한 이후로는 ICT(정보통신기술)를 중심으로한 민간조사 업무범위에 관하여도 민간조사업 법률안에서 함께 논의되어야 할 것이다. 이를 위해서는 민간조사업의 업무범위를 명확화하기 위하여 법규정의 강화하고, 벌칙 규정을 강화하여 입법화 단계에서 불필요한 논쟁을 불식시킬 필요가 있다. 또한 개인정보 침해사건이나 ICT 연계 민간조사활동이 지속적으로 증가할 것으로 예상되는 바, 이에 대한 법제도적 보완도 병행되어야 할 것으로 생각된다. 민간조사라는 새로운 직종의 출현과 외국계 민간조사업체의 등장으로 인하여 다른 법률과의 상충관계를 해소하는 방안도 함께 모색되어야 한다. 특히 이러한 노력은 단순히 민간조사의 업무범위와 관련된 사안일 뿐만 아니라, 민간조사의 감독기관에 대한 논의도 연관되어 있기 때문에, 앞으로 후속논의가 필요할 것으로 생각된다.

영문 초록

After a private investigation related bill submitted to Congress in 2005, the last 10 years are being continued discussion about the legalization of private investigation act. In particular, this service will be defined with respect to the possibility of such laws enhance privacy and human rights with regard to a scope of private investigation services. The recent major issues related to privacy and also occurred after about a focus on the ICT (Information and Communication Technology) Division private investigation services scope from private business to be discussed with the bill. We need to strengthen regulatory definition, and to dispel the unnecessary debate to clarify the scope of the civil action to strengthen the penalties prescribed in legislation business is to do this step. It is also thought to be likely to continue to increase privacy private investigation activities linked to ICT issues, this also can be combined to complement institutional law. The government and the industrial of private investigation should also seek ways to resolve the conflict with the relationship with other law due to the emergence of the foreign private investigation companies and the emergence of a new profession of private investigation. In particular, is thought to require a follow-up discussion forward simply because of work-related issues as well as a scope of private investigation work, but it is associated with a discussion of the director of a private investigation agency, such efforts. In 2011, after the enactment of the Privacy Act privacy and ICT-related human rights violations in the future as the important issue that should be discussed in private investigation related to such legislation will have to be combined for the discussion.
