독일과 미국의 연안경비에 관한 소고

국문 초록

특별법의 제정을 위한 여야의 노력이 계속되고 있는 지금, 세월호 사건은 이 나라의 미래인 학생들과 그 부모들에게 지워지지 않는 상처를 남겼고, 해상의 안전을 담당하는 대한민국 해양경찰에게도 회복할 수 없는 불명예를 안겨 주었다. 대한민국 헌정 수립 이래 동해와 남해, 황해의 안전과 경비를 담당해 온 해경이 정확히 그들의 잘못이라고만 할 수도 없는 세월호 사건을 계기로 역사의 뒤안길로 사라지게 되었다. 이 글에서는 독일과 미국의 연안경비에 관해 개관해 보고자 한다. 많은 국가 중에서 독일과 미국을 택한 이유는 첫째, 독일은 우리와 대륙법계의 전통을 공유하고 있는 국가이면서, 독일 기본법의 개정이 필요한 이유에서 단일한 연안경비체제를 갖추지 못하고 있기 때문에 어떠한 방식으로 연안경비의 근거법과 실행체제를 구축하고 있는지는 우리에게 많은 시사를 줄 것이기 때문이다. 둘째, 미국은 태평양과 대서양을 접하고 있는 국가이다. 삼면을 바다로 두고 있는 우리와 매우 흡사하며, 특히 우리의 해양경찰조직과 같은 단일한 연안경비대를 두고 운용하고 있다는 점에서 역시 많은 시사를 줄 것이다. 마지막으로 무엇보다 독일과 미국은 공통적으로 연방국가라는 점이다. 연방과 주의권한이 명확히 나뉘어 있는 이 두 국가에서 연안에 접해 있는 주와 연방정부의 권한이 어떻게 조화롭게 운용되는지를 살피는 것은 향후 우리나라의 연안관리에도 많은 시사를 줄 것으로 생각한다. 이를 위해서 우선 독일의 연안경비에 관해 살펴 본다(Ⅱ). 구체적으로 연안경비를 담당하고 있는 관청들을 고찰하고 각각의 관청들이 어떻게 제휴하여 해양의 경비와 안전을 유지해 가는지를 살펴본다. 그리고 미국의 연안경비대에 관하여 고찰한다(Ⅲ). 특히 해양안전의 보장과 관련된 직무와 그밖의 직무수행에 관하여 개관해 보고자 한다. 지면여건상 상세한 고찰은 할 수 없지만 개괄적인 고찰을 바탕으로 향후 대한민국 해양경찰의 모습을 어떻게 조정해 나가야 할 것인지에 관한 시사를 얻고자 한다.

영문 초록

The Coast Guard's value to the nation resides in their proven ability to accomplish the mission in the maritime domain, whether through saving lives, protecting the marine environment, or defending our country. Their unique authorities, capabilities, competencies, and partnerships as a military, law enforcement, regulatory, and humanitarian service are central to that value proposition. We are recognized worldwide for the Coast Guard's ability to execute these diverse maritime missions over vast geographic areas and under the most challenging and demanding conditions. The Coast Guard operates in the maritime domain, an enormous and complex environment. The physical characteristics of the sea present varying, dynamic and dangerous weather, seas states and water conditions. Human activity on the water continues to expand in a domain that does not readily sustain it. The maritime industry continues to evolve as the world remains fully dependent on global maritime trade in an advancing technology and information age. Varied and overlapping international and sovereign legal and policy regimes governing the maritime domain pose practical operational challenges. The Coast Guard requires a comprehensive concept of operations to successfully conduct operations in this unique operating environment. This paper focused on the two points of the system of the Coast Guard's in Germany and America. First, the 'firm' position of the Coast Guard. And secondly, coordination of the authorities. In Chapter Ⅱ, the author describes coordination of the authorities in Germany, and 'firm' position and national support for the Coast Guard in America in Chapter Ⅲ. It is the most important thing not to break up a organization for a mere stopgap measure but to support and reinforce the existing organizations. From such a perspective, the system of the Coast Guard in Germany and America suggests a new direction for Korea Coast Guard.
