국문 초록

본 연구의 목적은 2007년 제정된 중증장애인생산품 우선구매제도의 성과를 분석하고 개선방안을 도출해 보고자 한 연구이다. 우선구매제도의 성과는 동 제도도입 이후의 장애인생산품 매출, 중증장애인의 고용증가와 근로장애인의 임금상승률을 통해 측정해 보았으며 개선방안을 도출하기 위해 각국의 제도를 비교, 분석하였다. 본 연구결과는 첫째, 중증장애인생산품 우선구매 제도는 직업재활시설의 마케팅활동에 성과가 있었으며, 둘째, 증증장애인의 고용기회 제공에 성과가 있었으며, 셋째, 유급고용의 장으로서 장애인근로자의 임금상승 성과는 없었으며, 넷째, 우선구매제도의 우선구매 및 이행장치, 추진체계, 계약제도, 생산품 시설 지원 등의 제도적 측면에서 미흡한 부분이 많다. 본 연구결과를 토대로 이 제도가 중증장애인생산품시설의 마케팅을 지원하고 성과를 도출하기 위해 첫째, 우선구매를 위한 제도적 장치와 이행조치들이 개선되어야 하며, 둘째, 우선구매촉진위원회의 주관부처 개선과 수행기관을 법률에 명시하고 지원하며, 셋째, 단체수의계약제도 도입이 필요하며, 넷째, 중증장애인생산품 관리를 위한 지원방안이 마련되어야 한다.

영문 초록

This study analyzed the performance of preferential procurement of products manufactured by persons with significant disabilities in affirmative action. The results were as follows. First, the Special Act on the Preferential Purchase of Products Manufactured by Persons with Significant Disabilities had an marketing and employment effect of persons with significant disabilities. But, the wages on the rise did not do much. Also, The Special Act was riddled with limitation from overall system that includes the form of the enact and beneficiaries of the law, the implementation system, collective private contract system and specifying plans for product management and support. Based on the results of this study, here are several suggestions in order to have maintaining achievement of the Special Act, first of all in terms of enforcement, there is a limit to have administrative, criminal, and civil penalty provisions since the targeted purchasers are public institutions. So, it is most desirable to introduce the commanding system for priority purchase. Second, the position of the preferential purchase committee should be changed to a president-affiliated organization. Also, the preferential purchase committee needs to meet its obligation to specify the role of execution organizations by law and provide support for the various processes (certification, production planning, marketing, distribution, follow-up management) of PMPSD production facilities. Third, introducing a collective private contract system. Finally, specifying plans for product management and support.
