국문 초록

우리의 문화재보호법은 다시 정비되어 2011년부터 개정된 법이 시행될 예정이다. 새로운 문화재보호법이 지속적으로 쟁점이 되고 있는 정부사업 시행으로 인한 문화재와 환경 훼손에 대한 논쟁을 잠식시킬 수 있는 문화재 보호 장치의 역할을 할 수 있는지는 향후 지켜봐야 할 것이다. 이와 관련하여 미국의 유사한 문화재 보호 관련 법제를 살피면서, 미국에서는 환경과 연계된 문화재가 어떻게 보호되고 있는지를 알아보고자 한다. 이 글에서는 미국의 문화유산과 자연유산 보호에 관한 법제도를 개괄적으로 검토하고, 특히 정부사업 시행 전에 문화재 보호를 위한 환경 영향 평가 제도, 문화재의 사전 파괴를 예방하기 위한 절차, 건설사업 시공 시 문화재 훼손이 예상될 경우, 정부 사업을 금지하는 문화재 보호 관련법을 중점적으로 살펴본다. 또한 오키나와 듀공과 미국 정부의 군사기지 건설에 대한 미국 연방 지방 법원 판결을 통해 미국의 문화재보호법이 어떻게 적용이 되었는지를 알아본다.

영문 초록

In America, cultural property or cultural heritage has been protected as natural heritage. This integrated way of protecting cultural heritage with natural heritage may provide good references to us on how to protect our cultural heritage as well as surrounding environments which might be seriously impacted by the projects authorized or implemented by governmental agencies, and by neglect of the owners of cultural property. Thus, the paper primarily reviews the U.S. legal systems on protecting cultural property in general. Then, it attempts to introduce some of mandatory administrative procedures to prevent cultural property from being destroyed by federally-approved projects. Such administrative efforts are shown as some substantive or procedural regulations including Section 4f of the Department of Transportation Act of 1966, Section 110 of the National Historic Preservation Act of 1966(NHPA), which may protect cultural property from any 'anticipatory demolition,' and Section 106 of NHPA as one of the impact assessment procedures prior to governmental undertakings. In addition, the paper briefly analyzes legal issues of the Okinawa Dugong lawsuits against the U.S. Department of Defense decided in 2005 and 2008 to protect the habitate of the marine mammal from the potential construction of the U.S. military air station in Okinawa.
