국문 초록

노인인권에 대한 세계적인 관심의 증대에 따른 국제사회의 강력한 권고와 우리 사회의 필요에 부응하여 우리나라에서도 노인장기요양보험제도를 시행하게 되었다. 이 제도 하에서 주요 전문인력은 요양보호사이다. 현재 입소시설 종사자의 인권지침이나 교육은 어느 정도 논의가 진행되었으나 재가시설의 경우는 그렇지 못한 점에 착안하여 본 연구는 특히 재가시설 요양보호사들을 대상으로 그들이 노인과 노인인권에 대해서 어떻게 인식하고 있으며, 또한 노인을 돌보는 과정에서 노인인권을 어떻게 경험하고 있는지에 대해 질적조사하였다. 본 연구의 특징적인 결과는 다음과 같다. 연구결과 요양보호사들은 노인인권에 대해서 '스스로 결정할 수 있는 것', '자존심을 지키는 것'과 연결지었으며, 이러한 인식은 <유엔의노인원칙>에 들어있는 '보호', '존엄'의 원칙을 의미함을 알 수 있다. '스스로 결정할 수 있는 것'은 자기결정권을 의미하고, 이것은 노인의 자율성을 보장하는 것이며 또한 '보호'의 원칙에 연결된다. '자존심을 지키는 것'은 노인이 학대 받지 않고 존엄하고 안전하게 살아가야 하는 '존엄'의 원칙을 의미한다. 아울러 가족이나 시설종사자에 의해 자행되는 노인학대의 다양한 유형들이 요양보호사들의 직ㆍ간접적인 경험에 의해 드러났다. 요양보호사 양성과정에 노인인권과 노인학대에 관한 교육이 포함되어 있기는 하지만 노인의 인격과 존엄성을 침해하지 않으면서 질적 서비스를 제공할 수 있기 위해서는 이와 관련된 교육이 보다 강화될 필요성이 있다 하겠다.

영문 초록

Due to the increase of the global interests in the human rights of the elderly, our country also performs the long-term care insurance system, according to the duties to follow the instructions of UN and the needs in our society. For the implementation of this system, the core skilled manpower is careworkers. This study investigated careworkers' perception of the human rights of the elderly through a qualitative method. The distinguishing results from this study are as follows: The participants in the study perceived the human rights of the elderly as self-determination, self-esteem. The careworkers' perception of the human rights of the elderly did not completely conform to the existing human rights of the elderly, but it was found what they thought significant was the principle of 'protection' and 'dignity', among . Making their own decision means the right of self-determination, and this will guarantee the autonomy of the elderly and is associated with the principle of 'protection'. 'Keeping self-esteem' is associated with the principle of 'dignity', that the elderly should be able to live with dignity and safety, without being abused.
