교육감 직선제 도입에 따른 제 문제의 해결방안에 관한 연구

국문 초록

교육관련 종사자들의 간접선거를 통한 선출에서 주민의 보통․평등․직접․비밀선거를 통한 선출로 교육감선출방식에 변화가 있었다. 이러한 교육감의 주민직선제가 전면적으로 시행된 것은 2010년 6.2 지방선거에서부터이다. 교육감이 주민의 직선으로 선출되게 됨에 따라 교육감은 시·도지사에 상응하는 민주적 정당성을 갖게 되었고 이를 토대로 여러 현안 문제에 대해 이전과는 달리 자기 목소리를 내게 되었으며 교육정책의 추진에 있어서 시․도지사와 대립과 갈등관계를 종종 형성하였거나 형성할 개연성이 높아졌다. 한편 교육감선거과정에서도 후보자에 대한 정당공천이 금지되고 후보자의 정당표방이 금지됨에 따라 교육감선거에서 유권자의 후보자에 대한 알권리가 차단되어 교육감선거에 대한 유권자의 무관심으로 연결되어 낮은 투표참가율을 기록하는 현상이 나타났고 이른바 ‘줄투표 현상’으로 이어졌다. 이와 같은 문제점을 해소하여 교육감선거를 개선하는 방안으로 다양한 방안이 제시되었지만 본 논문에서는 교육경력(또는 교육행정경력)의 상향조정을 전제로 교육행정과 일반자치행정을 통합하여 시․도지사 아래에 교육부시장․부지사를 두고 시․도지사와 교육부시장(부지사)을 러닝메이트로 하여 선거를 통하여 선출하는 방안을 제시하였다. 이 방안은 교육감과 시·도지사 사이의 갈등관계를 해소할 수 있고 선거과정에서 나타난 여러 문제점을 시정할 수 있는 방안이 될 수 있을 것으로 판단된다. 오늘날 지방자치영역에서 일반행정과 교육행정의 통합이 세계적인 추세라는 점을 감안할 때 이 방안은 이러한 경향에도 부합하는 것이 될 것이다.

영문 초록

There is a great change in the Superintendent Election from the indirect election of the education interested to the direct election by Residence. It was the 6.2 Local Election that the direct Superintendent Election came into effect all over the country. As the Superintendent is elected directly by residence, the Superintendent has democratic legitimacy comparing with Mayors and Governors and carries out a lot of policies on the basis of this. This brings about conflicts between the Superintendent and Mayor(or Governor) in pushing ahead with the educational policy. Meanwhile, as the party cannot recommend a candidate of the Superintendent, voters are indifferent to the Superintendent Election and it causes the low participation rate of the Election. The Superintendent Election system should be kept balance between the principle of control by residence and management by specialist. This paper proposes that the a deputy mayor or a deputy governor of education should be installed on the assumption that educational administration is consolidated with general administration. This paper also proposes that a deputy mayor or a deputy governor of education should be elected with a mayor or a governor as a running mate. This system proposed by a paper solves a conflict between a Mayor and a Superintendent and resolves many problems appearing in process of the Superintendent Election. This proposed election system conforms with today world trend that educational administration is consolidated with general administration in the province of the local self-government.
