합리적인 공제조합 운영을 위한 법적 연구

국문 초록

유사보험으로 구분되는 공제(共濟)는 보험과 동일한 경제제도이며, 동일한 기능을 수행하고 있으나 보험업법이 적용되지 않고, 설립목적이 다른 각종 공제는 각 분야에 적용되는 특별법에 의해 설립되어 각각의 법률 규정에 따른 감독기관에 의해 규제와 감독을 받고 있기 때문에 그 기준이 상이하다. 반면 민영보험의 경우에는 관리․감독은 금융위원회에서 하지만, 공제는 설립근거법인 특별법에서 정한 주무장관이 함으로써 기준이 서로 다르고, 전문성이 미미하며 보험이론에 근거한 감독보다는 형식적인 행정관리 수준에 그치고 있다. 이처럼 공제는 보험과 동일한 기능을 하고 있음에도 불구하고 민영보험과 관리․감독 체계가 서로 달라 국제적 기준에도 부합하지 않고, 전문 성 없는 관리에 의한 재무구조 부실화, 소비자보호장치 미흡, 형식적인 감독으로 인한 국민의 신뢰도 저하 등 많은 문제점을 내포하고 있다. 이에 따라 본 연구의 궁극적인 목표는 자동차영역 공제조합을 중심으로 유사보험을 보험과 동일한 법체계 수준으로 정비하여 합리적인 공제조합 운영을 도모하는 것이라 할 수 있다. 이를 위해서 우선 공제조합에 대해 이론적으로 개관해보고, 자동차영역 공제조합의 일반현황을 파악한다. 그리고 미국, 영국, 일본, 캐나다 등 해외의 법․제도에 대해 검토함으로써 현행 공제조합의 문제점을 개선할 수 있는 방안을 모색하여 피해자 보호 측면에 비중을 두도록 한다.

영문 초록

An occurrence of a car accident not only brings losses of valuable human lives and properties but also brings serious physical, emotional, and economic damages to everyone concerned, the person responsible for the accident and victims of the accident. The car insurance was introduce to act as a social guarantee saving the accident victims as well as those who caused accidents from heavy economic losses. Car Insurance in Korea is divided into two categories, a general car insurance covering all types of private motor vehicles and Automobile Mutual Aid covering commercial motor vehicles such as buses, taxis and freight trucks.Under the circumstances, this study aims to propose solution to resolving the disputes involving Automobile Mutual Aides by analyzing the Automobile Mutual Aid system and its dispute cases, and identifying problems in the government's role as a supervisor. Problems in the Automobile Mutual Aids and their operations can largely be divided into two. One is the twofold compensation criteria and the weak coordination that can bring practical solutions to disputes through fair and objective investigation. The other is that mutual aid associations are not run independently but operated as auxiliary businesses of transportation business unions and that they are run as self-supported accounting systems according to government even though their scales are quite small. This leads to delayed compen sations and lack of expertise in the staff which in turn leads of lack of public confidence so that there are frequent occurrences of disputes over claims. In conclusion, victims' rights can be infringed upon with only the mutual aid associations or insurance companies involved in calculating extents of damages and due compensations. To prevent this, objective compensation standards need to be established and considerations given to institutions such as public damage audits and inspection system.
