국문 초록

이 글은 먼저 미국 연방 대법원의 Bilski 사건판결 내용을 살펴본 후, MoT 기준에 대한 연방 대법원 대법관의 일치된 견해의 의미, Bilski 발명이 추상적 아이디어에 해당한다는 대법원의 판단내용 및 영업방법이 미국 특허법 제101조에 규정한 방법발명에 속하는지 여부에 관한 법리를 살펴보았다. 또한, 영업방법 특허를 종래와 같이 그대로 유지한다 할지라도 State Street Bank 사건판결(1998년)에서 정립한 기준을 그대로 유지할 수 없게 된 판시사항을 분석하였다. 미국 특허법상 특허대상은 현행 특허법 제29조 제1항에 규정한 산업상 이용할 수 있는 발명에 상응한다. 이에 Bilski 사건판결에 비추어 현행 특허법상 관련 내용을 살펴본 후, 마지막으로 필자의 견해를 정리하였다.

영문 초록

Upon examining the judicial decision on the Bilski by the Supreme Court of USA, this article takes a closer look into the legal implication regarding 'the Machine or Transformation(MoT) Test', and the Court's judgement that the invention of Bilski et al is indeed an abstract idea. Also it deals with further discussion of whether the business method of Bilski et al meets the patent-eligibility of Patent Act. Moreover the detailed analysis of the previous State Street Bank Test which demonstrates the incapable circumstance on the interpretation of the business method gives the chance to review the legal policy and its practices on the protection of our business method. The Court's decision on the Bilski leads the patent policy as well as the authoritative interpretation on the business method; the former associates the forest which signifies the scale of patent protection based on the information technology, the latter associates the tree which signifies the patent-eligibility and the patentable subject-matter of an invention, when it compares to ‘the forest for the tree.’
