국문 초록

  본 연구는 1977년 제정과 1979년 시행 그리고 1994년 전문 개정 등의 과정을 거치면서 30개성상의 긴 세월 동안 한국 특수교육과 그 발전을 위한 정책수립의 근원이 되어왔던 「특수교육진흥법」이 2007년 5월 26일 전격 폐지되고 그 대체 신법으로 제정된 「장애인 등에 대한 특수교육법」의 일부 규정을 이론적으로 그리고 법리적으로 분석하기 위한 것이다. 본 연구에서는 동 법의 제명(題名), 목적, 주요 법정용어의 정의를 중심으로 이를 관련 타법 및 「특수교육진흥법」의 규정 등과 비교ㆍ분석하여 그 타당성, 합리성, 실효성 등을 평가하고 그것이 현실특수교육에 미칠 함의를 해석하였다. 이러한 결과에 따라 향후의 법률개정과 정책수립의 방안 내지 방향을 제시하였고, 이와 함께 후속연구가 필요한 사항들을 제언하였다.

영문 초록

  The Special Education Promotion Law, which was enacted in 1977, implemented in 1979 and completely revised in 1994, had been the foundation for Korean special education and its policy development during the last three decades. On May 26, 2007, this law was replaced by the Special Education Law of Individuals with Disabilities and the Like. The purpose of this present study is to conduct a theoretical and legal analysis of some regulations of this newly enacted special education law.
  More specifically, this study compared and contrasted the Special Education Law of Individuals with Disabilities and the Like with other related laws and the Special Education Promotion Law in terms of the title, purposes, and definitions of major legal terminologies. This study also evaluated the validity, rationality and efficacy of the Special Education Law of Individuals with Disabilities and the Like and provided interpretations of its effects in the field of current special education. As a result, the direction of future revisions of this newly enacted law and policy development are provided, and necessary components for further research are suggested.
