국문 초록

  본 연구는 WCPFC의 자원 보존ㆍ관리조치 이행체제를 개관한 것이다. 중서부태평양은 우리나라 원양어업의 주된 어장일 뿐만 아니라, 장래에도 가장 중요한 해외어장으로서의 가치를 가진 곳이다. 따라서 WCPFC의 해양생물자원 보존ㆍ관리조치 이행체제 수립과정에서 국가이익을 수호하기 위한 대응책을 수립하는 것은 마땅하며, 능동적으로 그 과정에 편입되어 주도적 역할을 하는 것이 옳다고 본다. 이와 관련하여 당해 업계는 새로운 국제어업 질서를 충실히 이행하여야 함과 동시에, 국가의 적극적인 국익수호 노력이 병행되어야 할 것이다.
  첫째, 국가는 VMS 정보를 수신할 수 있는 어업감시센터(FMC)를 설립하여 필요한 설비를 갖추고 운영하여야 하며, 공해조업선은 어업허가 기간 동안 협약수역에서 어선의 위치를 지속적으로 보고할 수 있도록 공인된 성능의 VMS 장치를 장착하고 정상적인 상태로 운용해야 한다.
  둘째, 국제 옵서버 프로그램 시행에 적극적으로 임함으로써 해양생물자원 보존ㆍ관리조치와 과학적 통계자료 수집에 관하여 WCPFC와의 협력기반을 구축하여야 한다.
  셋째, WCPFC 협약수역 내에서의 비선적국 검색선에 의한 승선검색제도의 시행에 능동적인 대비책을 수립해야 한다.
  넷째, WCPFC 「승선검색절차규칙」의 원만한 이행을 위하여 원양어선과 정부 당국 간의 유기적인 Net-work을 구축할 필요가 있다.
  다섯째, WCPFC 협약수역에서 IUU 어업을 예방하고 근절하기 위한 적극적인 행정지도와 업계의 실천 노력이 요구된다고 할 것이다.
  이와 같은 이행체제의 발전에 대응하여 우리나라는 최근에 「원양산업발전법」을 제정하여 원양어업국으로서의 국내법적 실행근거를 마련한 바 있다.

영문 초록

  This article is an overview of reorganizing process of international fisheries regime, especially cauterized on WCPFC. The Western Central Pacific Ocean is not only the major fishing ground of distant-water fishery, but also the high valued overseas fishing ground of Korea in the future.
  So, it should be ensured that establish countermeasures which prevent the nation"s profits under the process of implementation system in WCPFC conservation and management measures for marine living resources, and take the leading role with participation in that process actively.
  In that matter, concerned industries should perform the new international fisheries regime in fidelity, at the same time government authorities should make all the efforts for protecting national interests.
  Firstly, government should establish the Fisheries Monitoring Center which can be received information from VMS, and provide required facilities and operate them well, while the fishing vessels participating high seas fishery is requested to have VMS system which is widely recognized it"s capacity and to operate it appropriately for reporting regularly the ship"s position on the convention area during the term of validity of fishery permit.
  Secondly, it should be established the foundation of cooperation with WCPFC that is about conservation and management measures for marine living resources and acquisition of scientific data, as working on passive way to participate in enforcement of the regional observer program.
  Thirdly, it should be established the passive preparation against enforcement of boarding and inspection system by the inspection vessel of the non-flag state within WCPFC convention area.
  Forthly, it would be necessary to establish organic net-work between distant-water fishing vessels and Korean Government Authority for amicable performance of「The Regulations for Boarding and Inspection Procedures」in WCPFC.
  Fifthly, it would be necessary for active administrative guidance and practice efforts of industry to prevent and eliminate IUU fishing activities within WCPFC convention area.
