공해생물자원 관리규범으로서의 생태계기반 관리

국문 초록

  최근 국제식량농업기구(FAO) 통계에 의하면, 많은 세계해양자원이 과도개발 또는 고갈된 것으로 나타났다. 이러한 상태로까지 진행된 궁극적인 원인은 과도한 어획에서 기인한 것임을 의심할 바 아니지만, 일부 전문가들은 전통적 어업관리시스템의 결함에서 기인한 것으로 지적하기도 한다. 이러한 상황을 개선하고 지속가능한 어업을 보장하기 위하여 전통적인 접근법에서 벗어나보다 통합적인 접근으로 전환할 필요가 있다.
  이 연구는 공해생물자원 관리규범으로서의 생태계기반 관리를 분석ㆍ고찰하려고 한 것이다. 이를 위하여 첫째, 전통적인 자원관리시스템의 문제점을 고찰하고, 생태계기반 관리의 개념을 파악하려고 했다. 둘째, 유엔해양법협약상의 공해생물자원 관리규범에 관하여 고찰하고 생태계기반 관리가 출현하게 된 배경을 소개하였다. 셋째, 다양한 국제법률문서를 통해서 생태계기반 관리와 관련된 조항을 파악하고 넷째, 지역수산관리기구를 중심으로 그 이행실태를 고찰하고자 하였다. 그리고 마지막으로 이를 요약ㆍ정리하고 약간의 제안을 하고자 했다.
  이 연구의 결론은 다음과 같다. 첫째, 해양생태계는 복잡성ㆍ변동성으로 인하여 아직도 완전히 이해할 수 있는 단계에 까지는 이르지 못했음을 확인하였다. 둘째, 해양생물자원의 지속가능성을 위하여 생태계기반 관리를 도입해야 할 필요성 및 당위성을 각각 발견했다. 셋째, 생태계기반 관리의 관련규정들은 대부분의 경우 법적인 구속력을 갖지 못했음을 확인하였다. 넷째, 공해상에서의 이행상황은 전반적으로 볼 때, 초기단계에 머물러 있는 실정이었다. 마지막으로, 공해생물자원 관리규범으로서의 생태계기반 관리가 완전한 이행단계에 이르기 까지는 상당한 시간이 걸리겠지만 그럼에도, 생태계기반 관리는 핵심적인 공해어업 관리규범 중의 하나로 올바른 방향으로 나아가고 있다는 것을 확인하였다.

영문 초록

  Recently, the FAO statistics showed the greater part of world"s marine resources were overexploited or fully exploited. There is no doubt that the ultimate cause of this reality is overfishing, but some experts in this field pointed out the deficiency of a conventional fisheries management system. To improve this situation, we need to focus on a more holistic approach by breaking from a conventional approach to guarantee sustainable fisheries.
  This study intented to analyze and review the ecosystem-based management to fishery in the high seas. To do this, first, Author defined the ecosystem-based management. Second, Author introduced ecosystem -based management. Third, Author found out stipulations in the various international instruments. Fourth, Author checked the implementation condition and finally, Author summarized previous descriptions, and made suggestions.
  In conclusion, first, Author found that the marine ecosystem is a very complicated and is not fully understood so far. Second, we have to introduce an ecosystem-based management to ensure sustainability of marine resources. Third, the provisions related to the ecosystem-based management don"t have a binding forces in common. Fourth, the implementation of an ecosystem-based management in the high seas fisheries still remains in an early stage as a whole. Finally, Author believe it will take considerable time until the approach is fullyimplemented, however it is progressing in the right direction towards becoming one of the important high seas fisheries management norms.
