국문 초록

  세계화의 시대적 흐름속에서 중국도 법치주의와 이의 행정법적 구현으로서 행정의 법률적합성원칙이 점점 제도적으로 정착해 가고 있으며, 이러한 원칙은 해양행정법영역에서도 책임행정의 원칙, 합법성원칙, 합리성원칙으로 구체화되어 가고 있다. 이러한 제원칙은 그 동안 법제적 정착과정에서 여러 차례의 시행착오를 거치기도 했지만, 이제는 어느 정도 법제도 및 시민의 법의식에 정착되었다고 볼 수 있다. 중국의 경우 입법, 사법, 행정 가운데 특히 행정이 권력의 행사과정이나 국가운영에 있어서 기능적으로 가장 중요한 수단으로서 그 역할을 담당하고 있다. 이러한 연유로 중국의 공공부문개혁의 핵심과 제로서 책임행정의 원칙, 합법성원칙, 합리성원칙을 내용으로 하는 법치행정의 원칙의 실현이 세계화의 조류속에서 법치국가의 구현을 목표로 하고 있는 중국의 현 상황하에서는 매우 중요한 문제로 부곽되고 있다. 특히 이러한 법원칙은 아직 통일적인 해양관련 실정행정법이 체계적으로 마련되어 있지 못한 중국의 현실에서 해양행정법의 기본원칙으로서 매우 중요한 의의를 가지게 된다.

영문 초록

  Rule of law is becoming social ictus more and more in the globalization age. Chinese society has step on the road of the progress toward rule of law firmly after several turns and twists. Administration has most the strong power in the contemporary public powers, therefore, administration according to Law as a revolution of government administration is especially important. There is no uniform code for maritime administrative law all over the world, basic principles of maritime administrative law have important significance.
  This paper lays emphasis on a discussion about the meaning and content of China’s maritime administrative law of Responsibility Administration Principle, Principle of Lawfulness, and Principle of Reasonableness, and lays special stress on the important relationships among them.
