지방관공선재해복구공제규정에 관한 고찰

국문 초록

  지방관공선은 도서지역의 도서민을 위한 행정지원업무, 어업인을 위한 어업지도업무, 도서지역의 자연보호업무, 도서민의 의료지원업무 및 소방업무 등을 주로 수행하고 있는 국민의 소중한 재산이다. 지방관공선이 주로 운항하는 장소가 해상이기 때문에 해상에서의 선박운항은 세심한 주의를 다하더라도 언제나 사고와 재난에 노출될 수 있다는 점은 부인할 수 없는 사실이다. 따라서 지방관공선도 해상에서의 사고와 재난에 대비하여 사전에 선박보험 또는 선박공제에 가입해야 하는데 현재 지방관공선은 당해 선박의 사고로 발생된 물적손해 또는 비용손해를 보상받기 위해서는 지방자치단체관공선관리규정 제16조 제1항의 규정에 의하여 강제적으로 한국지방재정공제회에서 운영하고 있는 지방관공선 공제기금에 가입해야 하는데, 이를 위해 운영되는 공제사업이 지방관공선재해복구공제사업이며, 이러한 사업은 한국지방재정공제회가 제정한 지방관공선공제규정에 의하여 운영되고 있다. 따라서 이 논문에서는 1차적으로 지방관공선 공제기금에 가입하는 당사자가 지방자치단체라는 점을 고려할 때 당해업무의 담당자가 공제 또는 보험의 원리에 대한 전문적 지식이 부족하다는 점은 부인할 수 없기 때문에 지방관공선공제규정에 있어 가장 핵심이 되는 지방관공선의 감항능력 전제조건, 공제금지급사유 및 제한사유와 충돌공제특약에 대하여 해석론적 고찰을 행한 후, 2차적으로 본 규정의 문제점 및 개선방안에 대하여 제시하고자 한다.

영문 초록

  Local government vessels are precious national properties that carry out services for island residents such as administrative support, fishery patrol for fishers, environment protection in island areas, medical services and fire fighting for island residents. Because local government vessels are carrying out their tasks mainly on the sea, it is inevitable for them to be exposed to the risks of accidents and disasters however carefully they make navigation. Accordingly, local government vessels should also be covered by ship insurance or ship mutual insurance in preparation for accidents and disasters on the sea, but currently they have to join the Mutual Aid Fund for Local Government Vessels operated by the Korea Local Finance Association under Article 16­1 of the Regulations on the Management of Local Self governing Bodies’ Ships in order to get compensation for property or monetary losses caused by any accident of the ships. The mutual aid program operated for this is that for recovery from disasters in local government vessels, and this program is run by the Regulations on Mutual Aid for Local Government Vessels established by the Korea Local Finance Association. In consideration of the fact that the policy holders of mutual aid insurance for local government vessels are local self-governing bodies, it is undeniable that personnel in charge of this task lack expert knowledge of the principles of mutual aid or insurance. Thus, the present study purposed primarily to review reasons for restrictions on the payment of mutual aid, which are the most crucial points in the Regulations on Mutual Aid for Local Government Vessels and the collision liability special clause, and then secondarily to identify problems in the regulations and propose improvements for them.
