영문 초록

  Evolutionary biology sets up hypothesis of human sexuality on the basis of the theory of genetic selection and explains male sexuality and female sexuality by means of the modern theory of evolution. This paper studies the possibility of normative judgement obtainable from that hypothesis of sexuality in male and female. So it takes notice of the hypothesis that there are sex differences between male and female, and it arrives a norm that more rights must be given to female than now through the criterion of "need" in justice. Law tries to realize the equalitarianism that reflects sex differences. Then this paper examines the sexual power relation permeated in the law in force. Especially, it considers the positive and negative aspects of biological hypothesis that operates in the existing criminal regulations.
  Concretely, I scrutinize the object of an act in rape and criticize the theory of construction in the academic world and judicial precedents in relation to the "degree of outrage or threat" in rape.
