경계표지 등록 제도 도입에 관한 연구

국문 초록

  어떤 필지에 대한 지상경계와 지적공부상의 도상경계는 당연히 일치해야 한다. 그러나 우리나라에서는 경계를 확인시켜 줄 법률적 효력이 있는 경계표지가 지상에 설치되어 있지 않고, 도상경계로서 경계복원측량을 하는데 현실적으로 많은 어려움이 있어 토지경계분쟁이 많이 발생하고 있다. 본 논문에서는 이에 대한 근본적인 해결방안을 제시하기 위해 먼저 국내의 제도를 조사하고, 독일, 일본, 캐나다의 경계표지관련 제도를 조사하였다. 이러한 내용을 바탕으로 우리나라에서 지적관리에서 토지의 경계에 대하여 법률적인 효력을 가진 경계표지를 설치하도록 하며, 그 위치와 내용을 기록하는 경계점등록부의 신설을 제안하였다. 경계점등록부는 지적공부로서의 인정되도록 하여야 하며, 경계점등록부에 등록된 경계표지는 토지거래 및 토지분쟁에서 경계의 위치를 나타내는 법적인 효력을 가지도록 하여야 한다. 경계표지의 망실의 경우에는 경계점등록부를 기준으로 복원한다. 이러한 제도의 도입과 실시는 토지경계분쟁을 최소화하게 되며, 지적재조사의 효과를 가지게 될 것으로 생각된다.

영문 초록

  The land boundary of a parcel should be justly consistent with the boundary on cadastral registration records. But in Korea there is no cadastral boundary monument which has legal validity to prove cadastral boundary on land. Therefore there are actually many difficulties in cadastral land boundary reinstate surveying based on the boundary on cadastral registration records, and also many land boundary disputes are occurred. To solve this matter fundamentally, this paper investigate Korean System, and Geman, Japanese, Canadian system regarding cadastral boundary monument. Based on these investigation, this study proposed that cadastral boundary monument which has legal validity regarding land boundary should be constructed for Korean cadastral registration, and the cadastral boundary point registration book which records its position and the specification of cadastral boundary monument should be established. Cadastral boundary point registration book shall be regarded as one of cadastral record book, and the cadastral boundary monument which are registered in cadastral boundary point registration book shall have legal validity to represent the position of land boundary in land trade and land dispute. If the cadastral land boundary is destroyed, it shall be reconstructed based on cadastral boundary point registration book. The establishment and execution of this system will minimize the land boundary dispute, and will result similar effects to cadastral resurvey.
