영문 초록

Korea should have used New Commercial Code of Japan(here in after NCCJ) after the Korean independence from Japan in 1945. It is that we say Old Commercial Code. Enacted in 1962, Our Commercial Code should be reception of the Commercial Code of Japan. So we have to assay Old Commercial Code of Japan(here in after OCCJ) to know and to be have to grip that the origin of Commercial Code of Japan. As a result in further examination at the source and the original form in OCCJ, it is surprised to that the OCCJ had reception of the English Commercial Code in some measure at being the contrary to our expectation. In order to apply the law with correctness, We understand to know origin of the provisions and the Code. So Such study have an important meaning.
