정신장애인 절차보조사업의 한계 및 개선방안

국문 초록

강제입원은 심각한 인권침해로서, 정신장애인에게 트라우마를 남기며 치료의 결과에도 효과적이지 않다. 이에 강제치료 과정에서 정신장애인의 의사와 선호를 반영하는 지원의사결정이 강조되고 있다. 한국에서도 2018년부터 절차보조사업이 시범사업으로 시작되어 2021년 본 사업으로 전환되었으며, 2025년까지 전국적으로 확대할 계획이다. 이에 본 연구에서는 절차보조사업의 현황과 한계점을 분석하고, 영국의 독립정신건강옹호 제도와의 비교를 통해 향후 개선방안을 도출하고자 하였다. 독립정신건강옹호 제도에서는 서비스 이용 자격을 강제입원과 지역사회 강제치료까지 포함하며, 이용 권리 고지를 법적 의무화 하고 서비스 평가에도 반영한다. 반복적인 의사 확인과 기록, 거부 의사를 밝히지 않는 한 동의를 가정하는 옵트아웃 방식을 강조함으로써 서비스 접근성을 향상시켰다. 옹호자가 되기 위한 훈련과정을 체계화 하며, 이용자를 만나고 회의 참석 및 기록을 조회할 수 있는 권한을 부여함으로써 실제적인 권리옹호가 가능하도록 하였다. 이러한 연구결과를 바탕으로 절차보조사업의 개선방안으로 권리옹호를 위한 의사결정지원의 역할 규정, 권리로서의 서비스 접근성 강화, 절차지원가의 역량강화 및 권한보장에 대해 제언하였다.

영문 초록

Compulsory hospitalization is a serious human rights violation, imprinting trauma on the people with psychiatric disabilities and not effective for the treatment outcomes. Therefore, emphasis is being placed on providing support decision-making that reflects the will and preferences of the people with the psychiatric disabilities during compulsory treatment. In Korea, the procedural assistance project commenced as a pilot project in 2018, converted to the main project in 2021, and expected to expand nationwide by 2025. This study analyzed the current issues and limitations of the procedural assistance project, and attempted to derive future improvement through comparison with independent mental health advocacy of UK. In the independent mental health advocacy, the eligibility for service use includes compulsory hospitalization and community treatment order, and the notice the right to use is legal obligations and reflected in service evaluation. Service accessibility was improved by emphasizing the opt-out method, repeated confirm and records The training process for becoming an advocate was systematized, and the authority to meet users, attend meetings, and inquire records made it possible to actually defend rights. Based on the results, it was suggested to define the role of decision-making support for the protection of rights, ensure access to services as a right, and enhance the competence and empowerment of procedural assistant
