국문 초록

목적: 본 연구는 웰니스관광과 관련된 법제도에 대한 이론적 고찰 및 비교 분석을 통하여 웰니스 관련 법제도를 이해하고 비교법적 시사점을 도출하고자 한다. 그리고 이를 통하여 웰니스 관광자원을 관리하고 개발하기 위한 제도화 과정에서 시사점을 도출하는 것을 연구의 목적으로 설정하였다. 방법: 연구 목적을 달성하기 위하여 본 연구는 웰니스관광과 웰니스 관광자원에 대한 개념을 이론적으로 정리하였다. 그리고 웰니스를 대상으로 한 법률과 지자체 조례에 대한 비교법적 접근을 통하여 웰니스 관광자원을 제도적 관점에서 이해하였다. 끝으로 이러한 이론적·제도적 고찰을 바탕으로 웰니스 관광자원에 대한 시사점과 정책 제언을 도출하였다. 결과: 웰니스 관광자원에 대한 제도적 고찰을 통하여 법률과 조례 사이에 웰니스에 대한 이해에 차이가 있음을 확인할 수 있었다. 이러한 차이는 웰니스에 원활한 제도화를 저해하는 요소로 작용될 수 있다. 또한 웰니스관광 관련 법률의 제정 과정이 체계적이지 못하여 웰니스자원에 대한 관리와 활용에서 법률 간의 충돌이나 법률과 조례 사이의 충돌이 생길 수 있다. 이러한 충돌은 법체계의 일관성의 해치는 결과로 이어질 수 있다. 결론: 웰니스 관광자원과 관련된 논의를 통하여 시사점과 제언을 도출할 수 있었다. 본 연구의 웰니스 관광자원에 대한 제도적 연구 결과는 향후 이어지 웰니스관광 육성을 위한 정책 마련에 기초자료로 활용될 수 있다. 그리고 이러한 연구 결과의 활용을 통하여 보다 체계적이고 효율적인 웰니스 관광자원의 관리 및 개발이 이루어 질 수 있기를 기대한다.

영문 초록

Purpose: This study aims to understand the legal system related to wellness tourism through theoretical reviews and comparative analyses. By comparing relevant laws and regulations, this study seeks to derive comparative legal implications. The study aims to provide insights into the institutionalization process for managing and developing wellness tourism resources. Methods: This study theoretically defines the concepts of wellness tourism and wellness tourism resources. Additionally, a comparative legal approach was employed to examine laws and municipal ordinances related to wellness, providing an institutional perspective on wellness tourism resources. Finally, based on these theoretical and institutional analyses, implications and policy recommendations regarding wellness tourism resources were derived. Results: Through an institutional review of wellness tourism resources, differences in the understanding of wellness between laws and ordinances were identified. These differences may hinder the smooth institutionalization of wellness-related policies. Moreover, the legislative process for wellness tourism-related laws was found to be unsystematic, potentially leading to conflicts between different laws or between laws and municipal ordinances. Such inconsistencies may undermine the coherence of the legal framework. Conclusion: This study derived relevant implications and recommendations. The findings of this institutional study on wellness tourism resources can serve as a foundational reference for future policy formulation aimed at promoting wellness tourism. By utilizing these findings, it is expected that a more systematic and efficient management and development of wellness tourism resources can be achieved.
