국문 초록

이 논문은 학부모 관련 입법 정책의 배경과 관련 법령을 분석하고, 이를 통해 입법 방안을 제시하는 것을 연구목적으로 하였다. 2024년에 정부는 새로운 시대적 흐름에 부합하는 학부모정책을 제시하였다. 그러나 현행 법률 안에서 과제를 도출하다보니 한계가 분명하게 드러났다. 또한 헌법과 관련 법률을 분석한 결과, 학부모의 권리와 의무, 책임 등에 대한 의미와 한계들이 도출되었다. 이러한 법적 문제점을 개선하기 위한 입법 방안은 다음과 같다. 첫째, 학부모 등 보호자의 교육 지원 강화를 위한 법률적 근거를 마련해야 한다. 둘째, 민법상 부모의 자녀 교양 권리ㆍ의무에 대한 실질적 지원을 실시하기 위한 법적 근거를 마련해야 한다. 셋째, 학부모 교육참여 및 학교참여 유급 휴가제를 도입해야 한다. 넷째, 학부모 교육 등 학부모 정책의 체계적 지원을 위한 학부모지원센터 설립 근거를 마련해야 한다.

영문 초록

The purpose of this paper is to analyze the background of legislative policies related to parents and related laws and regulations, and to suggest legislative measures through them. In 2024, the government proposed a parent policy that fits the new trend of the times. However, as tasks were derived from the current law, limitations were clearly revealed. In addition, as a result of analyzing the Constitution and related laws, the meaning and limitations of the rights, duties, and responsibilities of parents were derived. Legislative tasks to improve these points are as follows. First, it is necessary to establish a legal basis for strengthening educational support for guardians such as parents. Second, under civil law, a legal basis must be established to provide practical support for parents' rights and obligations to educate their children. Third, a paid leave system for parental participation in education and school participation should be introduced. Fourth, it is necessary to prepare the basis for the establishment of a parent support center for systematic support of parent policies such as parent education.
