늘봄학교 법제화를 위한 법안 비교 분석 - 초등돌봄 정책 관련 법제화 동향을 중심으로

국문 초록

2025년 전국 시행을 앞두고 있는 늘봄학교 정책은 현재 방과후교실과 초등돌봄교실을 일원화하는 것에 더 나아가 지역아동센터, 다함께돌봄센터, 청소년방과후아카데미 등 학교 밖 돌봄 시설까지 ‘늘봄’ 브랜드로 통합하려는 계획을 발표하였다. 이로 인해 여러 부처와의 원활한 연계가 더욱 필요하게 되었고, 뚜렷한 법적 근거 없이 운영되었던 초등돌봄교실 정책의 근거 법 제정에 대한 문제가 다시 제기되었다. 이 연구는 초등돌봄 정책 관련 법제화 동향을 총체적으로 분석하고, 각 법안 간의 내용상의 차이가 어떠한지 살펴보았다. 이러한 연구 결과를 토대로 향후 늘봄학교 법제화를 위한 쟁점을 도출하고 입법과제를 제언하였다. 해당 연구는 제16대 국회부터 제22대 국회에서 발의된 의안을 중심으로 자료를 수집하였으며, 체계적 문헌분석 PRISMA 방법을 활용하여 최종 선정된 10개의 의안을 중심으로 비교 분석을 하였다.

영문 초록

The Neulbom School policy, which is set to be implemented nationwide in 2025, announced a plan to integrate out-of-school care facilities such as local children's centers, together care centers, and youth after-school academies into the ever spring brand. For this reason, the need for legislation related to elementary care classes, which had been operated without a clear legal basis so far, has increased. This study analyzed the trends in legalization related to elementary care policies so far and examined the differences in content between each bill. Based on these research results, issues and legislative tasks for the legalization of Neulbom School in the future were suggested. This study collected data centering on the bills proposed by the 16th to 22nd National Assembly, and analyzed the 10 documents finally selected using the systematic literature analysis PRISMA method. As a result, the following three research results were revealed. First, continuous changes in the contents of the bill were observed as social consensus on the subject of the elementary care class operation was not reached. Second, it was confirmed that more detailed discussions on the concept of care were needed by reversing the reduction and expansion of the target of the elementary care class. Third, it was found that the bills proposed so far were insufficient to mention the elementary care class workers. It is argued that in order to legislate the Neulbom School in the future, it should be carried out after further discussion of the following three points.
