초·중등학교 교원의 생활지도권의 쟁점과 개선 방안

국문 초록

교원의 생활지도권 법제화 이후 교육활동 보호 강화 여부에 관한 현황 파악이 필요하다. 본 연구의 목적은 초·중등학교 교원이 생활지도권을 행사할 때 발생하는 쟁점을 분석하고 개선 방안을 제안하는 것이다. 목적을 달성하기 위하여 생활지도권의 개념과 법적 성격에 관해 검토한다(Ⅱ). 이를 바탕으로 학생생활지도 관련 법제의 문제점과 현실적 한계를 분석한다. 관련 판례를 검토하여 시사점을 도출하고 개선 방안을 제안한다(Ⅲ). 마지막으로 이상의 논의를 정리한다(Ⅳ). 현행 법령의 개정 방안으로서 학생의 기본권을 제한할 수 있는 생활지도 사항을 「초·중등교육법」 또는 동법시행령에 명시하고, 교원의 생활지도권 행사에 관한 구체적인 수단과 방법은 가이드라인 같은 연성법을 통해 규정하는 것이 타당하다. 학칙의 개선 방안으로는 불이익처분으로서 징계에 이르게 되는 생활지도의 내용과 방법을 명확하게 제시할 것, 교원의 생활지도권 행사 과정에서 금지하는 구체적인 지도 행위와 제재 내용을 규정할 것, 교원의 정당한 교육활동에 대하여 반복적으로 부당하게 간섭하는 학부모의 교육권 행사를 허용하지 않는 점을 분명히 할 것, 제·개정 과정에 학생과 학부모의 적극적 참여를 권장할 것, 학교장을 포함한 모든 교원의 생활지도가 촘촘한 협력 속에서 이루어질 수 있도록 권한과 역할 그리고 책임을 세부적으로 규정할 것을 제안한다.

영문 초록

The purpose of this study is to analyze the issues that arise when elementary and middle school teachers exercise their authority to guide students' lives and propose ways to improve them. To achieve this goal, we will first examine the concept of the right to provide guidance and the legal nature and content of the right to provide guidance to students by elementary and middle school teachers (II). Based on this, the limitations of the student life guidance-related legislation and legal conflicts in the actual exercise of student life guidance authority will be analyzed to propose improvement measures (III). Finally, the above discussion is summarized (IV). As a way to improve the current laws, the school guidance that can limit the basic rights of students should be specified in the 「Elementary and Secondary Education Law」 or the Enforcement Decree of the same Act, and the specific means for teachers to exercise their school guidance rights should be prescribed through soft laws such as guidelines. As a way to improve school regulations, it is suggested to clearly present the content and methods of life guidance that lead to disciplinary action as a penalty, to define specific guidance and sanctions prohibited in the process of teachers exercising their right to life guidance, to clarify that parents' right to education is not allowed to interfere with teachers' legitimate educational activities repeatedly and unfairly, to encourage active participation of students and parents in the process of establishment and revision, and to define in detail the authority, role, and responsibility of all teachers, including the principal, so that life guidance can be carried out in close cooperation.
