국문 초록

법률플랫폼이 리걸테크(legaltech)의 핵심적 서비스 전달방식으로 자리매김하면서 변호사법을 포함한 법조윤리 전반에서 새로운 쟁점들에 대한 검토가 필요한 시점이다. 본 연구는 법률플랫폼이 변호사업에 미치는 영향과 과제를 사건의 수임(변호사 광고)와 법률사무의 처리(법률문서 작성)을 중심으로 분석하였다. 먼저 법률플랫폼의 변호사 검색 서비스가 변호사법상 허용되는 광고인지 금지되는 유상의 소개·알선행위인지를 상세하게 살펴본다. 그리고 생성형 AI 기술을 활용한 법률문서 자동작성 서비스가 비변호사의 법률사무 취급에 해당하는지를 분석해 보았다. 이를 종합하여 합리적인 변호사 광고 규율방안과 생성형 AI 기술을 적용한 법률문서 자동작성 서비스를 규율하기 위한 법적 과제를 정리하였다. 법률플랫폼의 문제는 더 이상 직역 수호, 이해집단의 이익조정의 문제로 보아서는 안 된다. 이는 우리 사회의 구조적 전환에 따른 시대적 과제라고 할 수 있다. 이러한 난제를 풀어나감에 있어 무엇보다 국민의 사법접근성을 제고하고 법률 서비스 분야의 지속적 혁신을 가능하게 하는 법과 제도의 정비가 중요한 시기이다.

영문 초록

As legal platforms become a core service delivery method of legaltech, it is necessary to examine new issues in legal ethics, including the Lawyers Act. This study aims to analyze the impact and challenges of legal platforms on the legal business, focusing on case acceptance (lawyer advertisement) and legal work (legal document Generation). First, we examined whether lawyer search services on legal platforms are permissible advertisements or prohibited paid solicitations under the Lawyer Act. Then, we analyzed whether automatic legal document Generation services using generative AI technology constitute the handling of legal services by non-lawyers(Unauthorized practice of law). Based on these findings, we concluded that there are reasonable ways to regulate lawyer advertisements and issues to appropriately regulate automatic legal document Generation. The study concludes that attorney search services should be principally allowed as advertising, though supervision is needed regarding commission levels and recommendation algorithm fairness. Automated legal document services are currently not considered legal practice due to their lack of case specificity and legal reasoning process. However, the study suggests legislative amendments, including the Attorney-at-Law Act, or regulatory exemptions to promote legal tech development. The issue of the impact of legal platforms on the law business should no longer be viewed as a matter of protecting the profession or aligning the interests of interest groups. It is more of an issue of the times due to the structural transformation of our society. In solving these challenges, it is important to improve people’s access to justice and to overhaul laws and systems that enable continuous innovation in legal services.
