국문 초록

논문은 디지털 사회에서 개인정보의 활용이 증가함에 따라 발생하는 개인정보 분쟁의 특수성과 개인정보호법상의 분쟁해결제도의 개선방안에 관한 연구이다. 개인정보 관련 분쟁은 기존의 법적 분쟁과는 다르게 디지털화의 영향을 크게 받는 영역이며 이로 인한 복잡성이 증가된다. 기업들은 다양한 수단을 통해 개인정보를 수집 및 활용하고 있으며 개인의 프라이버시는 랜섬웨어, 피싱, 해킹 등의 방식으로 침해 위협을 받고 있다. 이러한 개인정보에 대한 침해는 감지가 어렵고 추적 및 증거 수집에 기술적 어려움이 따라 개인이 대응하기 어렵다는 한계를 가진다. 본 연구는 이러한 개인의 개인정보 침해구제의 곤란성에 주목하였다. 개인정보의 활용가치가 높아지면서 개인정보는 불법적 활자의 대상이 되고 있으며, 법적 소송은 고비용을 수반하는 반면 그 보상은 침해와 불편에 비해 적은 경우가 많다. 이러한 문제를 바탕으로 본 연구에서는 개인정보호위원회의 역할 강화를 통해 디지털 사회에 적합한 개인정보 분쟁해결제도의 개선방안을 제시하고자 하였다. 개인정보보호위원회는 감독, 국제 협력, 법적 체계 개선, 투명성 강화, 분쟁 조정 등 다양한 방법으로 개인정보와 관련된 분쟁을 해결하고 예방할 수 있는 지위에 있다. 또한 개인정보보호법상의 분쟁해결제도는 분쟁 당사자 간의 정보력 및 협상력 차이를 보완하고, 개인정보보호위원회의 전문성을 활용하여 효율적이고 실질적인 분쟁 해결을 가능하게 한다. 본 연구를 기초로 개인정보 침해가 가지는 특수성에 부합하는 실용적인 제도개선이 이루어져 개인정보 보호 및 분쟁해결제도에 대한 후속 연구가 이루어지기를 기대한다.

The proliferation of indispensable platforms and services has elevated the utilization of users' personal data, consequently giving rise to an escalation in personal information disputes. Over the past decade, the number of cases managed by the Personal Information Dispute Resolution Committee has surged by 582%. Traditional legal proceedings face formidable challenges due to substantial time and cost constraints, hindering expeditious resolutions. Furthermore, the multifaceted nature of personal information breaches adds complexity to accurately discerning the nuances of the damages incurred. Personal information breaches occur on various fronts, disseminating sensitive information through online behavioral tracking technology and big data analysis. Due to the unique characteristics associated with personal information, including anonymity, data intricacies, and technological vulnerabilities, a diverse range of breach methods emerges. Due to the unique characteristics associated with personal information, including anonymity, data intricacies, and technological vulnerabilities, a diverse range of breach methods emerges. Disputes related to personal information have the potential to evolve into significant issues affecting not only individual concerns but the entire societal landscape. Recognizing and increasing awareness of this importance, along with efforts for legal system enhancements, becomes imperative. This study aims to explore effective improvements in the system and appropriate policy directions for addressing disputes related to personal information.
