민간에서의 자율주행 자동차의 사고발생시 개선방안 연구

국문 초록

현행법상 레벨 4 이상의 자율주행 자동차에 대한 법제는 아직 부족한 점이 있기 때문에 민ㆍ형사 영역에 걸쳐 보완될 필요가 있다. 굳이 무어의 법칙을 떠올리지 않더라도 급격한 기술개발을 감안할 때 레벨 4 이상 자율주행 자동차의 상용화는 우리가 생각하는 것 이상으로 빨리 다가올 것이다. 이러한 점을 감안할 때 레벨 4 이상 자율주행 자동차에 대해서도 발빠른 대비가 필요하며 이는 민ㆍ형사영역을 가리지 않을 것이다. 이에 형사법적으로는 사고책임의 주체에 대해서는 자율주행 자동차의 사람 운전자의 운행지배 여지가 감소하고, 운전자 과실 인정 부분이 크게 줄어 운행책임 인정 가능성이 낮아지게 된다는 점에서 차량 제조사에 대한 형사책임의 방향성을 고려해야 함을 확인했으며, 민사법적으로도 제조물 책임 뿐만 아니라 제조물 책임법상의 면책가능성 제한을 검토했다. 다만 이렇게 제조사 측에 사고발생의 책임을 지우는 방향을 고려한다면 필연적으로 자율주행 자동차 산업의 위축이 발생할 수 있다는 점은 부인할 수 없지만 이는 사실적 영역의 문제이기도 할 뿐만 아니라, 사용자와 제조사 측에게 위험의 분배가 이루어지지 않는다면 자율주행 자동차의 시장 위축이 아니라 자율주행 자동차의 보급 자체가 회의적으로 이루어 질 수 있다는 점을 고려할 필요가 있을 것이다.

영문 초록

Under the current law, the legal system for self-driving cars of level 4 or higher still has some shortcomings, so it needs to be supplemented in both civil and criminal areas. Even if you don't necessarily think of Moore's Law, considering the rapid development of technology, the commercialization of level 4 or higher self-driving cars will come sooner than we think. Considering this, rapid preparation is needed for autonomous vehicles of level 4 or higher, and this will not discriminate between civil and criminal areas. Accordingly, in terms of criminal law, the scope for human drivers of self-driving cars to dominate the operation of autonomous vehicles is reduced, and the recognition of driver negligence is greatly reduced, lowering the possibility of recognition of driving responsibility, which is the direction of criminal liability for vehicle manufacturers. It was confirmed that this should be taken into consideration, and the limitations on the possibility of exemption under the Product Liability Act as well as product liability in civil law were reviewed. However, considering the direction of placing responsibility for accidents on the manufacturers, it cannot be denied that the self-driving car industry may inevitably shrink. However, this is not only a matter of fact, but also a distribution of risk between users and manufacturers. If this is not achieved, it will be necessary to consider that not only will the market for self-driving cars shrink, but the spread of self-driving cars themselves may be met with skepticism.
