학교안전사고에 있어 정신적 피해보상 인정 필요성에 관한 검토

국문 초록

「학교안전법」상 학교안전사고는 ‘생명 또는 신체에 피해를 주는 사고’라고 정의되며, 시행령에 열거된 이 사고에 포함되는 질병에는 정신질환이 포함되어 있지 않다. 이에 따르면 정신적 피해는 「학교안전법」에 따른 보상에서 제외되는 것만 같다. 하지만 최근 법원에서는 학교안전사고에 정신적 피해를 주는 사고를 배제해서는 안 된다는 판결이 나와 위와 같은 해석이 과연 타당한가에 관해 의문이 제기되었다. 이에 이 글에서는 학교안전사고에 있어 정신적 피해보상 인정 필요성을 도출하였다. 특히 그 헌법적 근거로는 ① 신체를 훼손당하지 않을 권리, ② 의무교육제도와 안전한 학교 환경, ③ 아동 시기의 인간 존엄성 및 행복추구권 등 세 가지를 제시하였다.

영문 초록

This article examines whether mental damage can be included in the damages caused by school safety accidents that the School Safety Act seeks to compensate. The purpose of the school safety deduction program under the Act is to provide prompt and adequate compensation for damages caused by school safety accidents. Therefore, it may be thought that mental damage should be included in the scope of compensation. However, the law defines a school safety accident as “an accident that causes damage to life or body. It does not include mental illness. Accordingly, it seems that mental damage is excluded from compensation under the School Safety Act, but a recent ruling has been issued that school safety accidents should include accidents that cause mental damage. This article examines the main contents of compensation for damages under the School Safety Act and examines the necessity of recognizing compensation for mental damages in school safety accidents. In particular, three constitutional grounds for recognizing mental damage compensation were presented: (1) the right to be free from physical harm, (2) the right to a compulsory education system and a safe school environment, and (3) the right to human dignity and the pursuit of happiness during childhood. He also derived the necessity of recognizing compensation for mental damage from the purpose of the School Safety Act, which is to provide prompt and adequate compensation for school safety accidents.
