논변논법으로 본 국가교육위원회 신설의 합리성 연구

국문 초록

본 연구는 새로운 교육거버넌스로서 국가교육위원회를 규정하고 있는 법률안이 발의되어 국회에서의 심의·의결되는 일련의 입법과정에 논변논법모형을 적용하여 분석하였다. 국회입법과정을 정책결정과정에 연계하고 논변모형을 적용하는 시도는 정책을 담고 있는 법률안의 형태와 내용 변화를 실효적으로 파악하여 정책의 합리적 연구에 도움을 준다. 교육정책 기구를 자문기구로 설치·운용하여 온 역사적 사실을 경로의존성의 관점에서 분석하여 정책 근거와 정당성을 비교하였다. 정책의 합리성을 제고하기 위해서는 기존의 실증분석과 주장의 내용을 질적으로 분석하는 논변의 합리적인 구조화가 병행되어야 한다는 데 대해 논의하였다. 논변논법으로 분석한 국가교육위원회 설치 정책에 관한 여야 의원의 발언과 정책 태도를 통해 정책을 바라보는 관점이 각 당의 당론에서 벗어나지 못해 합리적인 정책결정을 위한 민주적인 토론이 활성화되지 못하고 있음을 확인하였다.

영문 초록

Applying an argument model, this study analyzed the proposition, deliberation, and resolution process in the National Assembly concerning the legislative bill which prescribes the National Education Commission as a new educational governance. The method of connecting the legislative process to the policy-making process and applying the argument model is effective to track changes in form and content of the bill. This study also compared the policy’s basis and legitimacy by focusing on the path dependency and the historical fact that the educational policy organization has been established and operated as advisory body. In order to enhance the rationality of a policy, rational structuring of arguments that qualitatively analyze the content of existing arguments is required. The analysis of the legislative process for the establishment of the National Education Commission via the argument model, sheds light on malfunction of democratic deliberation for rational policy decisions.
