제주특별자치도 교육자치 활성화를 위한 입법 과제

국문 초록

이 연구의 목적은 도입 17년째를 맞고 있는 제주특별자치도의 교육자치의 성과와 한계를 진단하여 입법 과제를 제시하는 것이다. 2026년 6월로 예정된 교육의원 일몰제의 영향이 적지 않다는 점에서 그 입법 과제의 제시가 시급한 상황이다. 현 정부의 교육자치 관련 정책 방향은 교육자치를 강화하였던 문재인 정부와는 달리, 지방자치와의 통합으로 환원되었고, 그 일환이 교육감 러닝메이트제 추진이다. 제주특별자치도 교육자치가 갖는 의의는 2006년부터 지방의회 통합형 교육위원회 도입 전초 기지로서 역할을 해온 점, 교육의원 및 교육감 주민 직접선출제를 선도적으로 도입한 점 등이다. 그러나 시민단체가 교육의원 자격요건에 대하여 위헌소송을 제기하는 등, 정치적 개정을 통해 전국 최초의 교육의원제는 최후의 제도로 전락했다. 이는 최근 강원특별자치도(2023)와 전북특별자치도(2024)에 시사하는 바가 적지 않다. 제주특별자치도 교육자치 성과와 한계는 교육자치 입법, 교육자치 조직, 그리고 교육자치 재정 측면으로 나누어 살펴보았다. 특례를 활용한 비율은 77%(조레 제정은 58%)로 나타났고, 최근에 교육자치 활성화 조례가 제정되었다. 자치 조직에 있어서는 교육청 조직이 확대 되었고 제주형 자율학교도 확산 되었다(초등 46.5%). 교육재정 측면에서는 보통교부금의 고정 배정(1.57%)과 도세 전입금 비율 상향 조정(5%)을 들 수 있다. 활성화를 위한 입법 과제는 다섯 가지로 제시하였다. 통합 노력 의무 규정의 폐지(지방분권균형발전법 35조)를 통한 ‘헌법 체계성’ 회복 과제, 교육감의 특별자치도법 의견제출권 보장을 통한 ‘주민 대표성’ 반영 과제, 2026년 6월 예고된 제주 교육의원 일몰제 폐지를 통한 ‘민주적 정당성’ 회복 과제, 교육청 교육자치추진단 발굴 과제의 적극 수용을 통한 ‘지역 특수성’의 신장 과제, 끝으로 지방정치인과 시민단체의 교육의원에 대한 반감 극복을 통해서 ‘교육자치 체감도’를 개선하는 과제 등을 제시했다.

영문 초록

The purpose of this study is to present legislative tasks after diagnosing the achievements and limitations of educational autonomy in Jeju Special Self-Governing Province, which has been implemented for 17 years. This thesis consists of the following five chapters; I. Background and Transition of Education Autonomy Policy Ⅱ. Progress and current status of Educational Autonomy Ⅲ. Achievements and Limitations of Jeju Educational Autonomy Ⅳ. Legislative task for revitalization Ⅴ. Closing Words. The direction of the current government's educational autonomy policy is to integrate Educational Autonomy with Local Autonomy, which is in contrast to the previous government's strengthening of Educational Autonomy. The significance of Educational Autonomy in Jeju is as follows. The introduction of an integrated the education council member through referendum, and subsequent implications for the other Special Self-Governing Provinces(Gangwon, Jeonbuk, etc.). The achievements and limitations of educational autonomy in Jeju were presented in terms of legislation, organization, and finance related to Eucational Autonomy. The rate of using special exceptions was 77%, the organization of the Office of Education was expanded, and Jeju-style autonomous schools were also expanded(46.5% of elementary schools). The distribution of local education finance has also improved. Five legislative tasks for revitalization were presented. 1) Restoration of 'systematicity of the Constitution' through the abolition of the regulation on Decentralization Balanced Development Act(Article 35), 2) Restoration of 'resident representation' through guarantee of the superintendent's right to submit opinions about the Special Self-Governing Province Act, 3) The task of reviving the education council member system 4) the task of actively promoting the tasks(Jeju Provincial Office of Education), and finally, Tasks to increase the sense of Educational Autonomy felt by residents.
