교사의 학생생활지도권 근거 입법 이슈 분석

국문 초록

국회는 2022년 12월 27일 ‘교원의 학생생활지도’ 조항을 신설하는 내용 등을 포함한 초·중등교육법 개정안을 통과시켰다. 교직단체는 교권침해 사례를 근거로 유아교육법, 초중등교육법, 교원지위법 개정을 통해 교원에게 실질적인 생활지도권 부여, 피해 교원 보호 및 정상적 지도과정에 대한 민원, 법적 분쟁 시 법적 대응, 문제행동 학생 교육‧치유의 근거를 마련하고, 학생의 문제행동 시 즉각 분리조치 등 구체적인 대응 매뉴얼도 마련해야 한다고 주장했다. 이 논문에서는 ‘실질적인 생활지도권 부여’ 요청의 타당성을 살피기 위해 제시된 근거 자료와 사례와 생활지도권과의 관계, 현행 제도와 생활지도권 신설과의 관계를 분석한다. 법안의 실효성을 판단하기 위해서는 교권 추락 및 교권 침해 사례 발생의 원인, 인간이 가진 자제력의 특성과의 관계를 살핀다. 교사의 학생 생활지도권 보장 관련 법규정의 효과 및 한계를 분석하고 대안을 제시하기 위해서는 운암초등학교의 학교 규칙과 학생생활규정을 분석한다. 그리고 법안 개정 방향을 제시하기 위해서는 제시된 법안의 「아동학대처벌법」 및 「학교폭력예방법」과의 관계를 분석한다. 이 분석을 바탕으로 교사들이 기존의 권한을 제대로 행사하지 않는 이유에 따른 법과 제도 개선안을 제시한다. 그리고 미국의 사례를 깊이 있게 분석함으로써 법안과 정책이 나아갈 방향에 대한 시사점을 도출하였다. 이 논문에서는 학생생활지도권 입법 방향만이 아니라, 법으로 해결하기 어려운 한계 상황을 염두에 두며 근본적이며 장기적인 대책도 간단히 제시한다.

영문 초록

On 27 December 2022, the National Assembly passed an amendment to the Elementary and Secondary Education Act, including a new provision for teachers to guide students' lives. Based on cases of violation of teaching rights, teacher organizations have argued that detailed response manuals should be prepared, such as granting teacher’s practical guidance rights, protecting teachers from the complaints regarding normal guidance process, legal action in case of legal disputes, and immediate separation measures in case of problem behavior through the revision of the Early Childhood Education Act, the Elementary and Secondary Education Act, and the Teacher Status Act,In this paper, I analyze the relationship between the presented evidence and cases and the right to guidance, and the relationship between the current system and the new establishment of the right to livelihood guidance in order to examine the validity of the request for ‘actual guidance right grant’. In order to judge the effectiveness of the bill, the cause of the fall of teaching authority and infringement of teaching authority and the relationship between the characteristics of human self-control are examined. In order to analyze the effects and limitations of the laws and regulations related to the guarantee of teachers' right to student guidance and to suggest alternatives, the school rules and student guidance regulations of Gwangju Unam Elementary School are analyzed. In addition, in order to present the direction of amendment of the bill, the relationship between the proposed bill and the 「Act on the Punishment of Child Abuse」 and the 「School Violence Prevention Act」 is analyzed. Based on this analysis, the law and system improvement plan is presented according to the reasons why teachers do not properly exercise their existing authority. In addition, by deeply analyzing the case of the United States, implications for the direction of legislation and policies were derived. In this paper, not only the legislative direction of student life leadership, but also fundamental and long-term measures are briefly presented which is difficult to solve by law.
