국문 초록

챗GPT 4.0이 등장한 지 3개월, 해외기업과 협업한 스타트업 기업들이 연달아 법률 AI개발을 준비하고 있고 연말까지는 법률상담서비스가 출시되는 단계에 이르렀다. 그러나 관련된 논문이 부족한바, 향후 법조 시장의 미래를 분석하기 위해 AI에 의한 법률가의 대체 가능성을 AI의 연산처리능력, 법률적 사실관계 포섭능력, 법리이해능력, 가치판단능력으로 나누어 살펴보았다. 다음으로 법률 AI가 미칠 문제점으로 개인정보와 관련된 보안문제, 책임의 소재 및 신뢰 확보문제, 오남용에 대한 대책, 획일화된 판단에 대한 보정방법, 법조인들의 능력 저하에 대해 다루었다. 마지막으로 법률 AI가 가져올, 빠르면 2~3년 후의 미래에 대해 검토하였다. 따라서 본 연구결과는 AI가 법조인의 보조적 역할로써 국민들에게 양질의 법률서비스를 제공함으로써 신뢰를 확보하여 활용범위가 확대될 수는 있으나 완전히 법조인을 대체하기는 어렵다는 전망을 제시하였다.

영문 초록

Three months after ChatGPT 4.0 appeared, start-ups in cooperation with foreign companies are preparing to develop legal AI one after another, and by the end of the year, legal counseling services have reached the stage of being released. However, due to the lack of related papers, in order to analyze the future of the legal market in the future, the possibility of substituting lawyers by AI was divided into AI's computational processing ability, legal factual comprehension ability, legal understanding ability, and value judgment ability. Next, as problems that legal AI will have, security issues related to personal information, responsibility and trust assurance issues, countermeasures against misuse and abuse, correction methods for standardized judgment, and deterioration of the ability of lawyers were discussed. Finally, the future that legal AI will bring is reviewed as early as 2-3 years later. Therefore, the results of this study suggest that AI can secure trust by providing quality legal services to the public as an auxiliary role for legal professionals and expand the scope of use, but it is difficult to completely replace legal professionals.
