국문 초록

본 연구의 목적은 국제상사중재에서 내국민대우조항과 최혜국대우조항, 관할의 문제를 분석하고 이들 조항들에 대해 쟁점이 된 Vento v. Mexico사건을 중심으로 분석한 후 그 시사점을 제시하는 것에 있다. 이 사건의 신청인은 ①멕시코 정부에 의한 차별적 대우(NT·MFN 위반), ②멕시코 정부에 의한 MST 위반(적정 절차의 부족 등)에 대해 청구를 제기하고, 모두 배척되고 있다. 이 사건과 관련하여 수출 구조(NAFTA의 특혜관세를 이용해 수출한 산품을 수출처에 소재하는 투자재산을 경유하여 판매)를 이용한 다른 사업자를 특정할 수 있는지 여부, 또한 일반적인 절차에 따른 수입국 당국의 MST 위반에 대한 입증책임을 분석할 필요가 있을 것이다.

영문 초록

Purpose: This study analyzes issues over the national treatment clause, the most favored nation clause, and jurisdiction in international commercial arbitration under free trade agreements. Based on these clauses, implications after analyzing Vento v. Mexico are presented. Research design, data, and methodology: Adopting the literature research method, this study utilizes major related papers and Internet data. Results: For discriminatory application of an import restriction, an investor would need to identify other investors using the same trade agreement on which it is based, and must demonstrate that the import restriction does not likewise apply to these other investors. However, in this case, there is also a limitation in that it is more difficult for an investor who uses a unique business model that other investors do not use, to make a claim based on discriminatory treatment. Conclusions: The claimant in this case filed for ① discriminatory treatment by the Mexican government (breach of NT/MFN) and ② MST breach (lack of due process, etc.) by the Mexican government, but all of them were rejected.
